Resolution No.(208): "Ruling on Trading with Dealcoholized Grape Wine"

Resolution  No. (208)(18/2014), by The Board of Iftaa, Researches and Islamic Studies:

"Ruling on Trading with Dealcoholized Grape Wine"

Date: 30/Zolqidah/1435 A.H, corresponding to 25/9/2014 A.D

 

All perfect praise is due to Allah, blessings and peace be upon Prophet Mohammad and upon his family and companions.

The Board of Iftaa`, Research and Islamic Studies reviewed, in its twelfth session held on Thursday (30/Zolqidah/1435 A.H)-(25/9/2014 A.D), the letter sent by His Excellency, the Director General of the Jordan Food and Drug Administration in which he requested clarifying the Sharia ruling on the percentage of alcohol in “ Alcohol free grape juice “ product coming from Spain. The product is manufactured through fermentation first, then alcohol is processed out of it, without adding any chemicals, and that traces of alcohol remain in it, but these don`t exceed (0.04%) in the final product. It is worth mentioning that the product has a “Halal” certificate from the country of origin. It is also exported by the Kingdom of Saudi Arabia and the State of Kuwait.

After careful study and deliberation, the Board determined:

It is forbidden to have an intoxicant drink which is branded as “wine” even if it was dealcoholized  afterwards. The majority of the Muslim scholars deem that “wine” doesn’t become pure through being processed by human beings. This opinion is supported by the narration of Anas (May Allah be pleased with him) who reported that: ”when the Prophet (PBUH)  was asked if it is possible to process wine into vinegar, he said: (No)” {Muslim}. In addition, warding off harm lies in hindering such industry from becoming a reason for promoting and selling alcoholic drinks under the pretext that they are being processed and dealcoholized. Is it permissible to fish on Saturday?

All Perfect Praise be to Allah, The Lord of The Worlds, and may His Peace and Blessings be upon our Prophet Muhammad and upon all of his family and companions. 

It is permissible for Muslims to fish on any day, but the sons of Israel are the ones forbidden to fish on Saturday. Moreover, there is no evidence in Islamic Sharia prohibiting Muslims from fishing on that day. And Allah Knows Best.

A woman has asked her husband for Khulu`, her gold, deferred portion of the dowry and furniture. Is she entitled to that, knowing that her husband doesn`t want to divorce her?

Khulu`* can`t takes place save before a judge of Sharia and he has the authority to make the suitable decision in this matter. And Allah The Almighty Knows Best.
* Khulu' is when parties agree to separate by way of consent, usually upon terms such as the wife agreeing to repay her Mahr (dowry) to the husband upon him agreeing to grant Talaq. The iddah period (waiting time after a divorce) of a woman who seeks a khula, is one menstrual cycle or one month if she is post-menopause i.e. ceased menstruating. This is to ensure she is not pregnant. This differs from when a man gives a talaq; the iddah period is three cycles or three months.

I`m a university student. While I was sitting for an exam, the professor caught my fellow student cheating. I heard him telling her to hide the dossier. After the exam, he asked me to testify that I saw her cheating although I heard him telling her to hide the dossier but didn`t see her cheating. What is the ruling of Sharia on this?

It was narrated that the Prophet (PBUH) said to a man: "Do you see the sun?" He replied: "Yes." He said: "Give witness in a similar case [which is as clear as the sun], or leave it." [Reported by Al-Baihaqhi in "Sho`ab Al-Eman" pp.10964]. Therefore, it is not permissible to testify about something that you haven`t actually seen. And Allah The Almighty Knows Best.

Is it permissible for a person to give the Zakah (obligatory charity) to his daughter-in-law?

Yes, it is permissible for a person to give the Zakah to his daughter-in-law if she was poor, and none provided for particularly by whom are obliged to provide for her. And Allah Knows Best.
