بتاريخ (30/جمادى الآخرة/1440هـ) الموافق (7 / 3/ 2019م)

 

الحمد لله رب العالمين، والصلاة والسلام على سيدنا محمد، وعلى آله وصحبه أجمعين، وبعد

فإن مجلس الإفتاء والبحوث والدراسات الإسلامية في جلسته الثالثة المنعقدة يوم الخميس (30/جمادى الآخرة/1440هـ)، الموافق (7/3/ 2019م) قد نظر في الكتاب الوارد من معالي وزير الأوقاف والشؤون والمقدسات الإسلامية (رقم 4/6 /2 /14037، تاريخ 25/11/ 2018م) حيث جاء فيه: إشارة إلى قرار مجلس الأوقاف رقم 4/11 /2018، تاريخ 12/ 8/ 2018، والخاص بإعادة جزء من الحصص المسجلة من قطعة الأرض رقم (5) حوض رقم (3) البلد/ قرية الطنيب من أراضي جنوب عمان، والمسجلة باسم المتولي العام على الوقف وزارة الأوقاف والشؤون والمقدسات الإسلامية. راجياً سماحتكم الإيعاز لمن يلزم بعرض الأمر على مجلس الإفتاء لإبداء الرأي الشرعي، علماً بأنه تم تسجيل كامل القطعة مقبرة استناداً لقانون الأوقاف والشؤون والمقدسات الإسلامية رقم (32) لسنة 2001م. مرفقاً بطيه صورة عن القرار الموصوف أعلاه.

وبعد الدراسة ومداولة الرأي قرر المجلس ما يأتي:

قواعد الشريعة تقضي بأن تفرق وزارة الأوقاف والشؤون والمقدسات الإسلامية بين حالتين:

الأولى: إذا سجل الواقف أرضه وقفاً بحجة رسمية، ففي هذه الحالة تتولى الوزارة شأن الأرض المسجلة كاملة ملتزمة بشرط الواقف.

الثانية: إذا لم تسجل الأرض وقفاً، وإنما تم الدفن فيها عملياً دون حجة وقف، ففي هذه الحالة لا يجوز تسجيل الأرض كاملة باسم المتولي العام وزارة الأوقاف، وإنما غاية ما يمكن للوزارة تسجيله – بحسب قوانينها وأنظمتها – هو الجزء الذي تم الدفن فيه فعلياً مع حريم "ارتداد" يناسبه، دون باقي الأرض الفارغة. إذ الأصل بقاء ما كان على ما كان، والمساحة الفارغة من الدفن لم تتغير صفتها شرعاً، فليست من ولاية الأوقاف، بل تعاد لأصحابها. والله تعالى أعلم.

A man insulted the Divine Essence; is it obligatory for him to perform Ghusl?

 
Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
Insulting or blaspheming the Divine Essence (Dhat al-Ilahiyyah) constitutes apostasy (Riddah). The perpetrator of this grave sin must immediately repeat the two testimonies of faith (Shahadah) and sincerely repent to Allah the Exalted. It is recommended (Sunnah) for them to perform a ritual bath (Ghusl), though it is not a mandatory condition [for the validity of their return to Islam]. And Allah the Exalted knows best.

Should one who doesn`t perform prayer out of laziness make it up later, and how should he/she do so?

All perfect praise be to Allah,The Lord of The Worlds                                                                                                                                                              He/she is obliged to make up missed prayers by offering with each obligatory prayer another one, and if he/she offers two, then it is better. And Allah Knows Best.

What is the wisdom behind the legislation of fasting?

Fasting is a divine school from which the believer learns much and trains in virtues that may be needed in life. Among these virtues is patience, as it is the month of patience. Fasting also teaches honesty and consciousness of Allah in both private and public, for there is no observer over the fasting person in abstaining from lawful pleasures except Allah alone.
Fasting strengthens willpower, sharpens determination, and nurtures mercy and compassion among the servants of Allah. It is a struggle against the self, a restraint of desires, a purification of the soul, and a cultivation of goodness.
The Prophetﷺ said: "Allah, the Almighty, said: ‘Every deed of the son of Adam is for him, except for fasting; it is for Me, and I shall reward for it. Fasting is a shield. So when one of you is fasting on a day, let him not engage in obscene speech or raise his voice in anger. If someone insults him or fights him, let him say: I am a fasting person. By Him in whose hand is the soul of Muhammad, the breath of the fasting person is more pleasant to Allah than the fragrance of musk.’" [Bukhari and Muslim]
 

What is the ruling on shaving the head of the newborn?

It is desirable to shave the head of the newborn on the seventh day from delivery, and the weight of his/her hair is given in gold , or silver as charity.
