Resolution No.(192): "Ruling on Eating from a Vowed Sacrifice"

Date Added : 22-11-2015

Resolution No.(192)(12/2013) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Eating from a Vowed Sacrifice"

Date: 2/ Moharam/1435 AH, corresponding to 6/11/2013 AD.

All perfect praise is due to Allah , The Lord of The Worlds; and may His peace and blessings be upon our Prophet Mohammad and upon all his family and companions:

On its tenth session held on the above mentioned date, the Board reviewed a question emailed by one of the citizens, and it reads as follows: "I have vowed to sacrifice a calf for the Sake of Allah. Is it permissible for me and  my family to eat from it?"

After researching and deliberating, the Board arrived at the following decision:

Eating from the vowed sacrifice is one of the controversial issues among the Muslim Jurists, because some of them say that it takes the same rules of the sacrifice (Udhiyah), where the person, offering it, and his family are permitted to eat a third of its meat; whereas, some say that it takes the rules of the vow in terms of being donated for the sake of Allah, where the vow-taker and his family aren`t permitted to eat from its meat.

On their part, the Hanafite and the Shafite Jurists have forbidden the vow-taker to eat from the meat of the vowed sacrifice. Kindly refer to the book [Asna al-Mataleb, vol./pp.545].

Whereas, the Malikite and Hanbalite Jurists have permitted the vow-taker to eat from his vowed sacrifice. Al-Dosoukhi said: "If the vow-taker didn`t specify a certain animal and didn`t specify that it is vowed as a charity for the poor and needy, then he is permitted to eat from its meat." {Al-Hasheyah}. And Allah Knows Best.

Taking the above question* into consideration, the Iftaa` Board is of the view that it is permissible for the questioner to eat from his vowed sacrifice giving preponderance to the rules that apply to the Udhiyah.

Summarized Fatawaa

We collect funds from mosques and other sources, saying: "For the poor, the needy, widows, orphans, and those who do not beg insistently." After paying the stipends of the families registered with the Zakat Committee, an amount exceeding 6,000 dinars remained. Is it permissible for me to save it for upcoming months when I may not be able to collect the stipends?

These funds are received by the committee as representatives of the zakat payers to deliver zakat to those entitled to it. It is well-known that delaying zakat while being able to pay it is not permissible. Imam Al-Nawawi (may Allah have mercy on him) said: "Zakat must be paid immediately if one is able to do so, by the presence of wealth and the eligible categories." [Al-Minhaj] Therefore, the committee must distribute the zakat to the eligible recipients without installment payments or using it to purchase material goods for them, as the committee does not have authority over the poor to allocate it in this way. And Allah Knows Best.

Is a woman`s neck an Awrah (private part)?

All Perfect Praise is due to The Lord of The Worlds.

It is an Awrah, and it is forbidden for her to reveal it before non-Mahrams (Marriageable men). And Allah Knows Best.

Is speaking to a person from the opposite sex forbidden or not?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
Talking to a person from the opposite sex is forbidden in Islam because it entails a great deal of evil, which could lead to a graver sin. Moreover, Islam forbids having a friend from the opposite sex. And Allah The Almighty Knows Best.

I am pregnant with four twins since two months although I didn't have childbearing potential during the last four years. In addition, the doctor specialized in reprusccusions, already has notified me about the possible reprusccusions as a result of being pregnant with four twins as follows: abortion, Metrorrhagia, Premature birth, high blood pressure, gestational diabetes and the like. What is the ruling on aborting some of the aforementioned embryos? A medical report was attached in which the status of my question is clarified.

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Muhammad and upon all of his family and companions.
If the existence of the four embryos leads to critical reprusccusions/or threat on mother's health, life or a possibility of aborting all of them, then aborting one/two/three is permissible mitigate the above mentioned risks so long as the ages of the embryos don't exceed four months. And Allah Knows Best.
