Resolution No.(101) by the Board of Iftaa`, Research and Islamic Studies

 “Sharia Ruling on Lying in Sale”

Date: 4/4/1427 AH, corresponding to 3/5/2006 AD

 

 

 

 

Question:

 

Is it permissible for a trader to say that a certain item is made in Italy-for example-while it is either made in China, or made in China and shipped to Italy, or most of its parts are made in Italy and some of them are made in China?

Answer: 

The Board is of the view that a Muslim-whether a trader, a salesman, or whatever his work may be-must be truthful in all that he says and always tell the truth about each item that he promotes. It is forbidden for him to resort to lying and cheating under any circumstances. Prophet Mohammad (PBUH) said: “Truth leads to piety and piety leads to Jannah(Paradise). A man persists in speaking the truth till he is recorded with Allah as a truthful man. Falsehood leads to transgression and transgression leads to the Hell-fire. A man continues to speak falsehood till he is recorded with Allah as a great liar.“ {Bukhari & Muslim}. He also said: “He who deceives isn`t of us.“ {Muslim}. And he (PBUH) said: “A Muslim is the brother of a Muslim, so it is impermissible for a Muslim to sell a deficient item to his brother without mentioning that to him “ {Bukhari}. Is it permissible for a person to give the Zakah (obligatory charity) to his daughter-in-law?

Yes, it is permissible for a person to give the Zakah to his daughter-in-law if she was poor, and none provided for particularly by whom are obliged to provide for her. And Allah Knows Best.

Is it permissible to offer prayer at home, or should it be offered in the mosque?

All perfect praise be to Allah, The Lord of The Worlds.                                                                                                                                                                      It isn`t preferable for the man to pray at home as praying in the mosque is twenty seven times more rewarding. Therefore, this should motivate him to offer prayers in the mosque. And Allah Knows Best.

Is Zakah (obligatory charity) due on owned land?

Zakah is due on the land used as an article of merchandise and was originally bought for that end. Zakah is due on it at the end of every lunar year. Its value is estimated, and (2.5%) of the total value of all such lands owned by the questioner is given as Zakah. However, no Zakah is due on the land used for building a house, or an agricultural purpose.

What is the ruling on brown discharge before the menstrual period? Is it considered part of menstruation (Hayd)?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
Dusky discharge (Kudrah), reddish discharge (Humrah), and yellowish discharge (Sufrah) are all considered menstruation (Hayd) if they occur during the time of the menstrual cycle. If their duration exceeds a day and a night, and the period persists from the first sight of the discharge until the cessation of the menstrual blood—provided the total duration does not exceed fifteen days—then all of it is menstruation. However, if the duration exceeds fifteen days, then the discharge is not considered menstruation, but rather chronic irregular bleeding (Istihadah). And Allah the Exalted knows best.
