"Resolution No.(6): "Administration and Development of Orphans' Funds

Date: Rajab / 1408 AH, Corresponding to: 23/3/1985 AD

 

 

We received a question:

 

"What is the ruling on paying Zakat from the funds of orphans deposited in the Orphans Fund Development Foundation?"

 

The answer and all success attributed to Allah:

 

The Iftaa` Board has decided the following:

 

1- Zakat is obligatory on the wealth of minors and those in their stead, subject to the conditions of Zakat as prescribed by Islamic law.

 

2- In matters of Islamic rulings, they should be applied to all Muslims according to Islamic principles. It is not permissible to enact a law that selectively applies Islamic rulings to one group of Muslims while exempting others.

 

Therefore, the committee suggests that this issue be addressed within the framework of a comprehensive Zakat law that applies to all Muslims, including companies and institutions. Especially since the Temporary Zakat Fund Law No.3 of 1978, as amended by Temporary Law No.2/82, will soon be presented to the honorable National Assembly, by the permission of Allah. The committee hopes that the esteemed Assembly will prioritize the implementation of Zakat, as one of the pillars of Islam, comprehensively with care and attention.

Is the one offering the sacrifice liable if its meat spoils?

Praise be to Allah, and prayers and peace be upon our Master the Messenger of Allah.
 
If the meat (of the sacrifice) spoils due to the negligence of the one offering the sacrifice in preserving it, or due to improper storage, then he is liable to compensate for the portion due to the poor (which is estimated as half a kilogram of meat). If the sacrifice was a vowed (mandatory) one, then he is liable for all of it.
 
However, if he was not negligent, then there is no liability upon him, because its ruling is the ruling of a trust (like an item left in someone's care). And Allah Almighty knows best.

Who is the "Capable Person" for whom the Udhiyah is prescribed?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
The Capable Person (Al-Qadir): is the one who possesses wealth in excess of their own basic needs and the needs of their spouse, children, or anyone they are responsible for supporting, during the day of Eid and the three days of Tashreeq; as this period constitutes the designated time for the sacrifice. And Allah the Exalted knows best.

What is incumbent upon the one offering the sacrifice if, after slaughtering the animal, they discover that one of its internal organs is damaged or diseased?

All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
 
The presence of disease or defect in the internal organs of a sheep does not affect the validity of the sacrificial animal, unless the disease leads to the animal becoming emaciated and its meat becoming corrupted.
 
It is stated in al-Iqnā' (2/590) by Imam al-Shirbīnī: "The third disqualifying condition: an animal with a manifest illness — meaning one whose illness visibly results in emaciation and corruption of its meat. However, if the illness is minor and does not produce such effects, it doesn`t affect the validity of the sacrificed animal." And Allah Almighty knows best.

Is it permissible to participate in an Udhiyah?

Praise be to Allah, and peace and blessings be upon our master, the Messenger of Allah.
 
Regarding the sacrificial offering (Udhiyah), if it is a sheep or a goat, it only avails for one person. However, if it is a cow or a camel, it avails for seven people. It is permissible for the seven participants to have different intentions; for example, some may intend the sacrifice (Udhiyah), some the ’Aqiqah (sacrifice for a newborn), and others may simply intend to obtain meat.
 
It is stated in Hashiyat Qalyubi ‘ala Sharh al-Mahalli (Vol.4/P.256) and in Bushra al-Karim (p. 706):
 
"If one slaughters a camel or a cow on behalf of seven... it is permissible. Likewise, it is permissible if some of them intend their seventh for meat, and others intend their seventh for ’Aqiqah." And Allah the Almighty knows best.
