The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. I married a man and had two children; however, we got separated four years ago. In addition, my husband`s brother, paternal uncle of my children, has been providing for them ever since. In fact, he is an honest, well-behaved man. Is it permissible that we get married although his brother (My ex-husband) is still alive?

All perfect praise be to Allah the Lord of The Worlds. May His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

It is temporarily prohibited for a woman to marry her stepbrother. Therefore, once she receives Talaq Ba`in (Irrevocable divorce), she is allowed to marry her stepbrother, even if his brother (First husband) is still alive. And Allah The Almighty Knows Best.

Is it incumbent on the fiancée to obey her fiancé?

When the woman settles in her husband`s house, it is incumbent on him to provide for her and it is incumbent on her to obey him. Before that, and if the marriage contract had been concluded, then she is lawfully his wife and thus she should abide by custom in treating him, but if the marriage contract hadn`t been concluded, then she should treat him as a non-Mahram (Marriageable).

Is it permissible to have sexual intercourse with pregnant wife?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.

There is no sin in having sex with one`s pregnant wife as long as there is no medical condition preventing her from that. And Allah The Almighty Knows Best.

What is the ruling on exchanging kisses and hugs between husband and wife during the day in Ramadan?

Praise be to Allah The Lord of The Worlds.

It is disliked to kiss one`s wife during the day in Ramadan, and it is recommended to avoid that. And Allah The Almighty Knows Best.

Is it permissible to offer an absentee funeral prayer?

Yes, it is permissible to offer an absentee funeral prayer.

What should a worshiper who has forgotten a pillar of prayer do?

If he/she remembered the forgotten pillar before offering it in the following Rakah (unit of prayer), then he/she should offer it, and continue the prayer, then offer Sujood As-Sahw (Prostration of forgetfulness) at the end of it. But, if he/she remembered that forgotten pillar after having offered it in the following Rakah, then he/she should offer a new Rakah in its (the one in which he forgot a pillar) place, and offer Sujood As-Sahw.

After buying tires, I made an oath not to buy tires from a person. Afterwards, he offered his entire car for sale. What is the ruling on this?

If you bought the entire car and in order to be on the safe side, you should pay an expiation; feeding 10 poor people and the cost of feeding a person is half a JD. And Allah Knows Best.

Is it allowed for me to donate a flat to each of my children except one considering that the tuition fees I paid for the latter`s university study are equal to the price of the flat? In other words, he has received his share and this is why I`m donating a flat to my other children?
