Fasting and Curbing of Desires

The blessed month of Ramadan is an annual school that opens for thirty days to teach the believers how to curb desires and graduate holding the certificate of piety and righteousness.

The term "Curbing Desires" refers to the steering of instincts and desires according to the teachings of Sharia and controlling them by the Muslim.

One who is able to control his/her desires during daytime hours is able to control them for the rest of the day. Fasting is a training course that aims to achieve the meaning of humanity where the wisdom of mind and Sharia prevail over desires and instincts.

Fasting isn`t a form of torture; rather, it is intended to curb human instincts because when a human controls his/her instincts, he/she becomes human, but when they control him/her, he/she descends to the level of animals.

This is to weaken man`s power in order not to go too wild with his/her desires and instincts. Narrated 'Alqama: While I was walking with `Abdullah he said, "We were in the company of the Prophet (PBUH) and he said, 'He who can afford to marry should marry, because it will help him refrain from looking at other women, and save his private parts from committing illegal sexual relation; and he who cannot afford to marry is advised to fast, as fasting will diminish his sexual power." {Transmitted by Bukhari}. In other words, fasting diminishes sexual power.

In addition, the Messenger of Allah said: "Fasting is a shield." {Transmitted by Nasa`i}. In other words, fasting screens a Muslim from Hell.

Amongst the objectives of fasting are reducing the desire for food, drink, and women. This is in order not to get attached to the blessings and go astray as a result, but to get attached to the One bestowing them. The only method to curb desire is patience. “The Messenger of Allah (PBUH) counted them out in my hand” - or - “in his hand: ‘At-Tasbīḥ is half of the Scale, and “All praise is due to Allah (Al-Ḥamdulillāh)” fills it, and At-Takbīr (Allāhu Akbar) fills what is between the sky and the earth, and fasting is half of patience, and purification is half of faith.” {Transmitted by Tirmithi}. Fasting is half of patience because it entails endurance to perform this act of obedience (Fasting) and not committing sin (Breaking obligatory fasting). What is left is patience at times of calamity. Taking the narration where it was stated that patience is half of the faith, then fasting is quarter of the faith.

Allah wanted to curb our desires because indulgence in desires-even the lawful ones-could cause a person to fall into forbidden desires. Anas b. Malik reported: "The Paradise is surrounded by hardships and the Hell-Fire is surrounded by temptations." {Transmitted by Muslim}. The desire for food, drink, and enjoying women exists in every man and is allowed throughout the year except during the holy month of Ramadan. This is meant to achieve the following:

First: Teaching a Muslim that desires are a means not an end since food and drink are a means to preserve life and enjoying women is a means to preserve offspring. Accordingly, a Muslim shouldn`t dwell on the means leaving the ends.

Second: Reminding a Muslim to abstain from lawful things and blessings during the daytime of Ramadan, following the command of Allah in this regard.

Third: Strengthening the role of self-monitoring because abstaining from food and drink during the daytime of Ramadan, although able to eat and drink in private, makes a Muslim fear none but Allah, and he/she should remain conscious of this for the rest of the year.

Fourth: Hunger and thirst make a Muslim appreciate Allah`s blessings, so he/she shows gratitude when he/she needs them and doesn`t employ them in disobeying Allah. This is because gratitude is not to disobey Allah using His blessings.

Fifth: Fasting makes a Muslim remember his fellow Muslims who are deprived from food and drink or those who can`t afford marriage expenses, so he/she comforts them with supplication, at minimum. And all perfect praise be to Allah the Lord of the Worlds.

Summarized Fatawaa

What is the ruling of Islamic Law on performing ṭawāf on the upper floors of al-Masjid al-Ḥarām, given that these floors are situated above the level of the Ka‘bah, and that the one performing ṭawāf passes by certain barriers, such as pillars and walls, during the ṭawāf?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah ﷺ.
There are numerous conditions for the validity of ṭawāf (circumambulation around the Ka‘bah), among them: that the one performing ṭawāf be inside the Masjid (al-Masjid al-Ḥarām) — even if the Masjid has been expanded, so long as the expansion does not extend out into al-ḥill (land outside the sanctuary boundaries). It suffices for the ṭawāf to be performed in the airspace of the Masjid or upon its roof, even if that roof is higher than the Ka‘bah (the House) itself.
Al-Khaṭīb ash-Shirbīnī (raḥimahullāh) said: "It [ṭawāf] is valid upon the roof of the Masjid, even if the roof of the Masjid is higher than the House — just as prayer [is valid] upon Mount Abū Qubays despite its elevation above the House. This is the relied-upon (mu‘tamad) position." [Mughnī al-Muḥtāj, Vol.2/P.246]
The validity of the tawaf isn`t affected by the pillars and walls standing between the one performing ṭawāf and the House, since the condition is only that the person performing ṭawāf be within the boundaries of the Masjid and outside the boundaries of the Ka‘bah itself.
Ash-Shirbīnī said: "It [ṭawāf] is valid inside the Masjid, even if it is expanded, and even if a barrier stands between the one circumambulating and the House — such as a water-supply structure (saqāyah) or pillars (sawārī)." [Mughnī al-Muḥtāj, Vol. 2/P.246]
Accordingly, ṭawāf performed on the upper floors is valid, and the presence of barriers such as pillars and walls during the ṭawāf does not affect its validity. And Allah, the Exalted, knows best.

What is required of one who doubts the number of rakʿāt during prayer?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
If a person doubts the number of rakʿāt he has prayed, he should build upon the lesser number, as that is what he is certain of. He should then perform the prostration of forgetfulness (sujūd al-sahw) before the final salām at the end of the prayer. ʿAṭāʾ ibn Yasār narrated that the Messenger of Allah ﷺ said: "When any one of you is in doubt during his prayer and does not know whether he has prayed three rakʿāt or four, let him pray one more rakʿah and then perform two prostrations while seated before the salām. If the rakʿah he prayed was a fifth, these two prostrations will make it even; and if it was the fourth, then the two prostrations serve as a humiliation for the devil." (Reported by Abū Dāwūd.)
It is stated in al-Muqaddimah al-Ḥaḍramiyyah — one of the foundational texts of the Shāfiʿī school: "If one doubts whether he has prayed three rakʿāt or four, he is obliged to build upon the lesser number."
However, if such doubt recurs repeatedly and reaches the level of obsessive whispering (waswasah), he should not build upon the lesser number in that case — rather, he should build upon the greater number. And Allah the Almighty knows best.

I vowed to give a specific charity if a certain matter came to pass — what is the ruling on giving that charity before the matter is realised?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
Fulfilling a vow (nadhr) is obligatory, in accordance with the word of Allah the Almighty: "And let them fulfil their vows." [Al-Ḥajj/ 29] And the saying of our master the Messenger of Allah ﷺ: "Whoever vows to obey Allah, let him obey Him; and whoever vows to disobey Him, let him not disobey Him." (Reported by al-Bukhārī.)
The Shāfiʿī scholars distinguished between a financial vow (nadhr mālī) and a bodily vow (nadhr badanī). They permitted the fulfilment of a financial vow to be brought forward — before the stipulated condition is met — but did not permit the same for a bodily vow, which may only be fulfilled after the condition has actually been realised.
Shaykh al-Islām Imām Zakariyyā al-Anṣārī, may Allah have mercy upon him, states: "It is permissible to bring forward the fulfilment of a financial vow before the condition stipulated in it is met — such as saying: 'If I am healed, I vow to free a slave' or 'to give such-and-such in charity' — just as it is permissible to pay zakāh in advance. This is unlike a bodily vow, such as fasting." [Asnā al-Maṭālib, vol. 4/P.246]
Imām al-Bājūrī, may Allah have mercy upon him, states: "Like expiation other than fasting, a financial vow — such as saying: 'If Allah heals my sick one, I vow to free a slave for the sake of Allah,' or 'If Allah heals my sick one, I vow to free a slave on the Friday following the recovery' — it is permissible to bring it forward before the recovery in the first case, and before the Friday following the recovery in the second case." [Ḥāshiyat al-Bājūrī ʿalā Sharḥ Ibn Qāsim, Vol.2/P.596] And Allah the Almighty knows best.

Some online stores offer a discount on a customer's first purchase — what is the ruling on creating a new account each time a customer makes a purchase in order to obtain that discount?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
It is obligatory upon a Muslim to uphold honesty in both his words and his actions. Allah the Almighty says {what means}: "O you who have believed, do not betray Allah and the Messenger or betray your trusts while you know." [Al-Anfāl/ 27] And He says {what means}: "O you who have believed, fear Allah and be with the truthful." [Al-Tawbah/ 119]. And the Messenger of Allah ﷺ said: "Whoever deceives us is not of us." (Reported by al-Bukhārī.)
As for creating a new account for the same buyer, the terms and conditions of the website must be observed and respected. If doing so violates those terms, it is not permissible. And Allah the Almighty knows best.
