Resolution No.(184): "Ruling on Using Impure Sludge as Fuel for Manufacturing Cement"

Date Added : 17-11-2015

Resolution No.(184)(17/2012) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Using  Impure Sludge as Fuel for Manufacturing Cement"

Date: 5/2/1434 AH, corresponding to 19/12/2012 AD.

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

On its tenth session held on the above given date, the Board reviewed the question of the Secretary-General of the Ministry of Water and Irrigation, which reads as follows: "Sewage treatment plants produce-in addition to treated water- solids called "sludge", which should be gotten rid of, or reused as conditioned by the Jordan Standards. [Al-Khirbah As-Samrah] is one of the largest sewage treatment plants which has produced (200 tons) of sludge since 2007. As a result, substantial amounts of this substance have accumulated in that area. Therefore, there is a tendency to make use  of that substance in the best way possible in line with the following priorities: Burning it to produce cement, as this is the best option and the least expensive, or using it as manure, and the like. Could Your Grace be kind enough to consult the experienced scholars in order to clarify the ruling of Islamic Sharia on this issue, taking into consideration that using this sludge as fuel will relieve Jordan`s budget from (500, 000000) in the coming years.?"

After researching and deliberating, the Board decided the following:

The substance-sludge-produced by sewage treatment plants is impure; however, some scholars have permitted using impurity in such case since there is a dire need for it and it can be gotten rid of without causing harm to human beings, or to the environment.

After a representative from the Iftaa` Department has inspected  Al-Fohaise Cement Factory, it was found out that the sludge can be used as fuel where it is burnt at a high degree that reaches (1450 centigrade), and this massive heat breaks it down to iron atoms, lime, and similar raw materials attracted by the cement.

As a result, inceniration changes its nature and turns it into a pure substance, as is the opinion of the Hanafite School of Thought and one opinion of the Shafites. These scholars have stated: "If the nature of the impure substance has changed, the cause of impurity has ceased, or it has turned into a different substance in terms of  name and features, then this is enough to rule that it is has become pure, because the elements of impurity have vaefore". Therefore, there is no harm in utilizing  it in productive fields; especially if it leads to saving the aforesaid amount of money. And Allah Knows Best.

Summarized Fatawaa

Is my husband entitled to take my salary?

Your salary is yours, and you may give some of it to him as a kind of free-will contribution.

What is the ruling on men wearing rings (those made of silver and of other metals, such as iron), and are there conditions for men wearing rings?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
It is sunnah for men to wear a silver ring on the right hand, following the practice of the Prophet (peace and blessings be upon him). It is reported in Ṣaḥīḥ al-Bukhārī, on the authority of Anas ibn Mālik (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) took a silver ring and had “Muḥammad Rasūl Allāh” engraved on it. He said: “I have taken a ring of silver and had ‘Muḥammad Rasūl Allāh’ engraved on it, so let no one engrave the like of its engraving.”
It is a condition that the silver ring not exceed the size customary in the local norm (ʿurf). If it does, that is extravagance (isrāf). A ring made of a metal other than silver, such as iron or copper, is permissible to wear without disapproval (karāhah), except gold, which is forbidden (ḥarām) for a man to wear.
It is stated in Mughnī al-Muḥtāj (Vol.1/p.586): “It is permissible, without disapproval, to wear a ring of iron or lead. It is sunnah for a man to wear a silver ring on the little finger of his right or left hand. Wearing it on the right is better, and it is permissible on the left, and on both together.”
It is also stated in Mughnī al-Muḥtāj (Vol.2/p.97): “It is lawful for him, that is, the man, and likewise the khunthā (person of indeterminate sex), indeed all the more so, to wear a ring of silver, by consensus (ijmāʿ), because the Prophet (peace and blessings be upon him) took a ring of silver, narrated by the two Shaykhs (al-Bukhārī and Muslim). Wearing it is in fact sunnah, whether on the right or the left, though the right is better according to the sound position, as stated in the chapter on clothing in al-Rawḍah… The Shāfiʿī jurists did not specify the permitted size of the ring, and they probably relied on custom (ʿurf), that is, the custom of that country and the habit of people of his standing in it. Whatever exceeds that is extravagance, as they said regarding a woman’s anklet. This is the reliable position (al-muʿtamad).” And Allah Almighty knows best.

What is the ruling of Islamic Law on opening an account in a commercial bank in order to deposit a sum and use it for personal purposes, such as transfers and electronic payments?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
It is forbidden for a Muslim, if he has a choice, to open an account in an interest-based (ribawī) bank, even if the account earns no interest, because doing so assists in ribā, based on the saying of Allah the Exalted (which means): “And cooperate in righteousness and piety, but do not cooperate in sin and aggression.” [al-Māʾidah/2]
This is because such banks invest deposited funds in forbidden ribā-based transactions, and depositing with them is therefore a form of assisting them in what is unlawful. Assisting in what is unlawful is prohibited by the Sharīʿah. However, if there is a pressing need to open an account in an interest-based bank and it is not possible to open one in an Islamic bank, there is no objection to doing so.
The ruling on bank interest and the prizes distributed by interest-based banks was previously explained in Fatwa no. (471). And Allah Almighty knows best.

Is it permissible for the guardian to give Sadaqa (voluntary charity) from the money of the orphans?

It is impermissible for the guardian to donate from the money of the orphans because he is entrusted with the safekeeping of that money, and is prohibited from donating it.
