Resolution No.(101) by the Board of Iftaa`, Research and Islamic Studies

 “Sharia Ruling on Lying in Sale”

Date: 4/4/1427 AH, corresponding to 3/5/2006 AD

 

 

 

 

Question:

 

Is it permissible for a trader to say that a certain item is made in Italy-for example-while it is either made in China, or made in China and shipped to Italy, or most of its parts are made in Italy and some of them are made in China?

Answer: 

The Board is of the view that a Muslim-whether a trader, a salesman, or whatever his work may be-must be truthful in all that he says and always tell the truth about each item that he promotes. It is forbidden for him to resort to lying and cheating under any circumstances. Prophet Mohammad (PBUH) said: “Truth leads to piety and piety leads to Jannah(Paradise). A man persists in speaking the truth till he is recorded with Allah as a truthful man. Falsehood leads to transgression and transgression leads to the Hell-fire. A man continues to speak falsehood till he is recorded with Allah as a great liar.“ {Bukhari & Muslim}. He also said: “He who deceives isn`t of us.“ {Muslim}. And he (PBUH) said: “A Muslim is the brother of a Muslim, so it is impermissible for a Muslim to sell a deficient item to his brother without mentioning that to him “ {Bukhari}. Is Zakah (obligatory charity) obligatory on indebted merchant?

Debt doesn`t abrogate the dueness of Zakah, thus a debtor who has money, articles of merchandise, or other Zakah funds at his disposal should pay their Zakah.

Which is better in night prayer: long standing (Qiyam) or long prostration (Sujood)?

Long standing (Qiyam) is better in prayer. However, a Muslim should also observe tranquility and composure in their prayer.

What are the Sunnahs and etiquettes related to the slaughtering of an animal?

 

Praise be to Allah, and peace and blessings be upon our master, the Messenger of Allah.
 
1-The animal should not be terrified or frightened before it is slaughtered.
 
2-An animal should not be slaughtered in front of other animals.
 
3-It is recommended to offer water to the animal before it is slaughtered.
 
4-The knife must be sharpened before the slaughter to ensure that the esophagus, trachea, and jugular veins are severed as quickly and cleanly as possible. This is based on the Prophet’s (peace be upon him) saying: "Verily, Allah has prescribed Ihsan (excellence/proficiency) in all things. So, if you kill, kill well; and if you slaughter, slaughter well. Let each one of you sharpen his blade and let him spare the animal unnecessary suffering." [Narrated by Muslim].
 
5-One must not begin skinning or butchering the animal until its death has been fully confirmed.
 
6-Cows and Sheep: It is best to slaughter them while they are lying on their left side, facing the Qiblah. The right hind leg should be left untied so the animal can move it, which helps it remain more comfortable during its final moments. Unlike other livestock, it is preferred to perform Nahr (slaughtering by a swift stab at the base of the neck) while the camel is standing, with its left knee tied. And Allah the Almighty knows best.

What is the ruling on giving Zakah (obligatory charity) to one`s relatives?

It is impermissible to pay Zakah to one`s origins (parents and grandparents) because providing for them is an obligation on their branches (sons and daughters) if they were poor, but it is permissible to give some of the Zakah money to relatives whose provision isn`t due on the giver of the Zakah.
