Resolution No.(85): “Ruling on Exemption from the Rent of an Endowed Estate“

Resolution No.(85) by the Board of Iftaa`, Research and Islamic Studies:

“Ruling on Exemption from the Rent of an Endowed Estate“

Date: 26/2/1426 AH, corresponding to 6/4/2005 AD.

 

 

 

 

Question:

What is the ruling of Sharia on the request submitted by the Committee of Mosques and Charitable Projects in which it seeks to be exempted from the rent due on the basement of Abulkasim`s Mosque, which it uses as a rehabilitation centre for the Jordanian young women?

Answer: All success is due to Allah.

The Board is of the view that it is impermissible to exempt the above committee from the rent on permanent basis, and it should be recorded annually so as to ascertain the continuity of the endowed estate. However, it is permissible for the Endowments Council, later on, to relieve that committee from the whole rent or part of it since the committee is using that estate for charitable causes which agrees with the vision and message of the Ministry of Endowments. Is it enough to say Tasbeeh (Saying Subhaana Rabbiya Al-‘Atheem during Rukoo`, and saying Subhaana Rabbiya Al-A‘laa during Sujood ) once, or twice during Rukoo`(Bowing in prayer) and Sujood (Prostration)?

All perfect praise be to Allah, The Lord of The Worlds                                                                                                                                                                  Yes, saying Tasbeeh once during Rukoo` and Sujood is enough, provided that the worshiper`s attentiveness of the heart isn`t undermined during each. As regards the recompense, it depends on the number of Tasbeeh. And Allah Knows Best.

Is it permissible for an elderly person, a pregnant woman, or someone with a chronic illness to pay fidyah before Ramadan begins?

It is not permissible for an elderly person, a pregnant woman, or someone with a chronic illness to pay fidyah before Ramadan begins.
Additionally, it is not allowed to pay fidyah for more than one day in advance, because fidyah is a substitute for fasting, and fasting is not yet obligatory at that time.
However, it is permissible to pay fidyah for a single day in advance, by analogy with paying zakat up to one year in advance.

What is the ruling on a woman who takes medication to delay menstruation for fasting?

If a woman takes medication (to delay menstrual period) and does not experience menstruation, her fast is valid. However, she is not advised to do so unless there is a necessity.
If the medication harms her, even potentially, it is forbidden (haram) for her to take it.

What is the ruling on someone who doesn`t perform prayer?

All perfect praise be to Allah,The Lord of The Worlds                                                                                                                                                                    Not performing prayer is a major sin, and one who doesn`t pray out of laziness is considered an oft-sinner ;whereas, the one who denies that it is mandatory is considered a disbeliever.
