Resolution No.(59): “Ruling on Planting Trees in Graveyards“

Date: 9/11/1422 AH corresponding to 23/1/2002 AD.

 

Question:

What is the ruling of Islamic Sharia on planting trees in graveyards?

Answer: All success is due to Allah.

According to Islamic Sharia, planting trees in graveyards is permissible since it is included within the general meaning of the Sharia maxim which states that, in principle, things are permissible so long as there is no provision from the Quran and the Sunnah proving otherwise, and there is no evidence that forbids such an act. However, trees shouldn`t be planted directly above the graves, rather, they should be planted in the corridors and places where there are no graves. This is in order for their roots not to harm the dead because doing so is forbidden as stated in the Prophet`s Hadith {what means}: "Breaking a deceased body’s bones is exactly like breaking them when he is alive.” {Related by Abu Dawud in accordance with the conditions of Muslim}. Generally speaking, I`m dutiful to my mother and opt for obeying her. However, she chose a certain girl to be my future wife, but I`m not pleased with her choice although that girl comes from a good family and enjoys good character. Should I obey my mother or choose another girl that lives up to my expectations?

Praise be to Allah the Lord of the Worlds.

One must obey their parents in whatever is in compliance with the teachings of Sharia and within one`s capacity. However, you aren`t to blame for not marrying that girl, but it is better that you tell your mother about that and it is preferable that you perform Istikharah prayer. And Allah The Almighty Knows Best.

Is it permissible for a Muslim woman to wear trousers at home?

Wearing trousers at home isn't prohibited so long as non-Mahrams do not see her. And Allah Knows Best.

Is the father a Mahram (Non-marriageable) to his son`s mother-in-law?

The father is a non-Mahram (Marriageable) to his son`s mother-in-law, so it is impermissible for them to look at each other, or to have a seclusion (Khalwah).

Is the woman who do breastfeeding permitted to break the fast during Ramadan?

It is permissible for pregnant and breastfeeding women to break their fast during Ramadan if they fear harm to themselves or their child. However, they must make up for the missed fasts. If the fast is broken out of concern for the fetus or the baby, expiation (Fidya) is also required along with making up the missed fasts. The expiation involves feeding one needy person with an amount equivalent to a Mudd of food (approximately 600 grams of wheat or rice) for each day of missed fasts. If the fast is broken out of concern for the woman's own health, only making up missed fasts is obligatory. And Allah Knows Best.
