Resolution No.(59): “Ruling on Planting Trees in Graveyards“

Date: 9/11/1422 AH corresponding to 23/1/2002 AD.

 

Question:

What is the ruling of Islamic Sharia on planting trees in graveyards?

Answer: All success is due to Allah.

According to Islamic Sharia, planting trees in graveyards is permissible since it is included within the general meaning of the Sharia maxim which states that, in principle, things are permissible so long as there is no provision from the Quran and the Sunnah proving otherwise, and there is no evidence that forbids such an act. However, trees shouldn`t be planted directly above the graves, rather, they should be planted in the corridors and places where there are no graves. This is in order for their roots not to harm the dead because doing so is forbidden as stated in the Prophet`s Hadith {what means}: "Breaking a deceased body’s bones is exactly like breaking them when he is alive.” {Related by Abu Dawud in accordance with the conditions of Muslim}. Is it disliked to clip one`s nails at night, and to burn them afterwards?

It is recommended to bury hair and nails that have been removed and to conceal them in the ground. As for burning nails, we have not found any specific prohibition against it, but adhering to what is supported by evidence—burying the nails—is preferable. And Allah Knows Best.

 Is Hyena's Meat Permissible or Impermissible?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.
There is disagreement amongst the jurists as regards the ruling on eating hyena`s meat. Shafi`i and Hanabli jurists are of the view that eating hyena`s meat is permissible. The proof is the Hadith related by Al-Baihaqhi on the authority of Ibn Abi Ammar who said: "I asked Jabir bin Abdulla about hyenas, and he told me to eat them. I said: "Is it not game? He said: 'Yes' I said: 'Did you hear that from the Messenger of Allah?" He said: "Yes."  And Allah The Almighty Knows Best.

What is the ruling on Friday Ghusl (ritual bath)?

Friday Ghusl is a confirmed Sunna (Prophetic tradition) even if a person wasn`t in a state of Janbah (ritual impurity), or physically unclean. However, one who doesn`t make Ghusl on Friday isn`t sinful for the Prophet (PBUH) said: "It is good for a Muslim to make ablution for Friday prayer, but it is better to make Ghusul. [At-Tirmithi & Abu Dawood].

What is the ruling on obtaining a house through the King Abdullah II project (Decent Housing for a Decent Living), knowing that we do not own a house, our financial situation is moderate, our current rental costs are high, and we are eight people living in the household?
 
 
 
 
 

If owning the apartment/house is done through the same institution/project then it is permissible, but if this took place through usurious banks then it is impermissible, since dealing with usurious transactions is unlawful. And Allah Knows Best.
