قرار رقم: (34) حكم استثمارات صندوق الضمان الاجتماعي للتربية والتعليم من خلال إيداع الأموال في بنوك ربوية

أو شراء الأسهم

بتاريخ: 28/ 11/ 1413هـ، الموافق: 20/ 5/ 1993م

 ورد إلينا سؤال يقول فيه صاحبه:

ما الحكم الشرعي في استثمارات صندوق الضمان الاجتماعي للتربية والتعليم في إيداع الأموال في بنك الإسكان بفائدة، وشراء أسهم في بنك الأردن والخليج، وشراء أسهم في شركة التأمين العامة العربية، وشراء سندات تنمية من البنك المركزي، وشراء سندات قرض سلطة المياه من البنك المركزي الأردني، وشراء أسهم في الشركة العربية الدولية للفنادق؟

 الجواب وبالله التوفيق:

رأى المجلس  أن شراء الأسهم في مؤسسة ربوية حرام شرعًا؛ لأنه يعني تشغيل المال المستثمر بالحرام، وهذا ينطبق على شراء الأسهم في بنك الأردن، والخليج، وسندات التنمية الصادرة عن البنك المركزي، ومستندات قرض سلطة المياه من البنك المركزي.

أما إيداع الأموال في البنك الربوي بفائدة فهو حرام شرعًا أيضا، وهذا ينطبق على إيداع الأموال في بنك الإسكان بفائدة.

أما فيما يتعلق بشراء أسهم في الشركات بصفة عامة: فإن جواز شراء أسهمها متوقف على طبيعة عملها: فإن كان مشروعًا حلالاً فهو حلال، وإلا فهو حرام. والله تعالى أعلم.

What is the ruling on the fasting of a woman who has reached menopause if menstrual blood flows?

If a woman reaches the age of menopause (which is usually sixty-two) and her menses have ceased, then she sees blood after that, and its duration is not less than a day and a night (24 hours), it is menstruation (hayd). If it is less than a day and a night, she is considered as having non-menstrual vaginal bleeding (mustahada), so she fasts and prays. However, she must perform ablution for every obligatory prayer after its time enters, pray immediately, and be treated as a person with a continuous condition. There is no specific end limit for a woman's menstruation; it is possible as long as the woman is alive. And Allah the Almighty knows best.

What is the monetary value for the expiation of an oath (Kaffarat al-Yamin)?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
The expiation for an oath (Kaffarat al-Yamin) consists of feeding ten (10) needy persons. This is estimated at 600 grams of rice per person. It is also permissible to pay its value in cash, which is estimated at one dinar (per person). And Allah the Exalted knows best.

Does buying meat equivalent to the weight of a slaughtered animal and distributing it avail for an udhiyah?

Praise be to Allah, and prayers and peace be upon our Master the Messenger of Allah.
 
That does not avail for the sacrifice (uḍḥiyyah), because the sacrifice necessarily requires slaughtering an animal from the category of anʿām (camels, cattle, and sheep/goats) within a specified time.
 
Rather, that is considered a form of charity (ṣadaqah) for which one is rewarded, but not an udhiyah. And Allah Almighty knows best.

What is the ruling on fasting?

Fasting in Ramadan is an individual obligation (Fard ‘Ayn) upon every mature, sane Muslim who is capable of fasting.
Fasting can also be recommended (Mustahabb), such as voluntary fasting on Mondays and Thursdays, fasting on the Day of Arafah for those not performing Hajj, and fasting on Ashura.
Fasting can be prohibited (Haram), such as fasting on the two Eid days, the Day of Doubt (Yawm al-Shakk), and the Days of Tashreeq.
Some types of fasting are disliked (Makruh), such as singling out Friday or Saturday for fasting without a specific reason and fasting on the Day of Arafah for a pilgrim.
