About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. My mother is 70 years old and wishes to perform Hajj and Umrah, as she has never done so before. However, she also takes care of my ill father and is afraid of falling ill herself. What should she do?

If this is the obligatory Hajj – meaning she has not previously performed Hajj or Umrah – then it is permissible for her to go even without her husband's approval. However, she must travel with a Mahram (a male guardian) or a trustworthy group of women, and she should leave someone to care for her husband and attend to his needs. And Allah Knows Best.

What is the Islamic ruling regarding a person finding buried treasure, whether gold or artifacts, and what is their share of it?

If the buried treasure is Islamic, it is considered Luqta (lost property), and the finder must announce it to locate its owner. If all efforts to find the owner fail, the finder may take ownership of it. If the treasure is non-Islamic and consists of gold or silver, zakat must be paid on it, which is one-fifth of its value. And Allah Knows Best.

What is the ruling on a vowed animal sacrifice?

A vowed animal sacrifice is to be distributed amongst the poor and needy, and neither the vow-maker, nor those supported by him are to eat from it.

Is it permissible for a person who broke fasting in Ramadan because of being sick to pay a ransom?

If there is hope for him/her to be cured, then he would be required to make up for the missed fasting days when he/she recovers, and no ransom is due on him/her. If his/her disease is incurable, then he/she would be required to pay a ransom for each missed fasting day, which is (600) grams of wheat, or rice. And Allah Knows Best.

Is it true that if a ritually impure, or a menstruating woman visits one who is in confinement, harm will be inflicted on the latter, or her baby?

This is completely wrong and unfounded piece of information.

Is the one who doesn`t offer prostration of recitation during Quranic recital considered sinful?

Prostration of Quranic recital is a Sunnah due on whosoever recites a verse that contains a prostration. It is also a Sunnah for the reader and the listener. However, none of them is considered sinful for not offering it, but they deprive themselves from a great reward. It is obligatory to offer the prostration of Quranic recital in congregational prayer following the lead of the Imam.
