The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. I`m a university student. While I was sitting for an exam, the professor caught my fellow student cheating. I heard him telling her to hide the dossier. After the exam, he asked me to testify that I saw her cheating although I heard him telling her to hide the dossier but didn`t see her cheating. What is the ruling of Sharia on this?

All perfect praise be to Allah the Lord of The Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

It was narrated that the Prophet (PBUH) said to a man: "Do you see the sun?" He replied: "Yes." He said: "Give witness in a similar case [which is as clear as the sun], or leave it." [Reported by Al-Baihaqhi in "Sho`ab Al-Eman" pp.10964]. Therefore, it is not permissible to testify about something that you haven`t actually seen. And Allah The Almighty Knows Best.

Is it permissible for a wife to give her money to her family as a charity, or a gift without asking her husband, or seeking his consent?

The wife has the right to give her money as a charity, or a gift to her family, or to other people after consulting her husband out of respect, and this is the meaning of treating on footing of kindness and equity. Therefore, if he wanted to stop her from helping her family, then there is no harm in not telling him.

What should a person, who delayed making up missed fasts of last Ramadan due to the continuance of the same excuse, do?

It is permissible for one, whose excuse for not making up missed fasts of last Ramadhaan has continued, to delay fasting until the excuse ceases to exist, and he is considered neither sinful, nor obligated to pay a ransom. And Allah Knows Best.

Does the time of Fajr (dawn) prayer start after the first Athaan (call for prayer), or the second one?

It is desirable for the man to have one wife if there was no need for him to have more, if he can't afford marriage forthcoming expenses.

If the Prophet (PBUH) was an Arab citizen in 2009, born in an Arab country ruled by an Arab ruler, saw what was happening to Gaza, what would he (PBUH) have done?

What is the ruling on aborting a fetus affected by thalassemia?

If this is recommended by a trustworthy doctor who is god-fearing and knowledgeable, then it is permissible to have an abortion because some types of thalassemia are dangerous while some aren`t. And Allah The Almighty Knows Best.

What is the ruling on someone who prays Fajr late, after sunrise, knowing that they wake up on time but return to sleep and do not perform it within its time?

It is obligatory to perform the prayer within its prescribed time. If someone wakes up and knows how to act, they must perform it before the time ends. If they delay it, they are sinful and must make it up. And Allah Knows Best.
