About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. What is the ruling on taking a loan from an interest-based bank (a usurious bank) to buy an apartment for housing, noting that I am renting at a high amount relative to my income, and I am an employee? Also, considering that the conditions of Islamic banks are strict, and I cannot obtain the full amount from them, is it permissible to take a loan to purchase an apartment or not? May Allah reward you.

Usury (interest) is prohibited by Islamic law, and the Messenger of Allah, peace be upon him, cursed the one who consumes usury, the one who pays it, its recorder, and its witnesses. Whoever leaves something for the sake of Allah, Allah will compensate them with something better and greater, and Allah will provide relief after hardship. Needing a place to live does not permit taking a loan with interest. And Allah Knows Best.

Does offering Udhiyah (Offering a Sacrificial animal at Aid Al-Adha) avails from offering Aqiqa?

Offering an Udhiyah doesn't avail a person from offering Aqiqa because each of which is a different act of worship. And Allah Knows Best.

Is it allowed for a Muslim woman to wear nail polish?

Praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

Nail polish is an adornment that a woman is allowed to wear for her husband, and not in the presence of non-Mahram men. However, during ablution water needs to reach the nails, so it isn`t possible to perform 'Wudu (ablution) with nail polish on. Therefore, it isn`t valid to make Ghusl Jnabah (Ghusl performed after sexual intercourse or ejaculation), Ghusl after menstruation and Ghusl after Nifas (blood of childbirth) while wearing nail polish. And Allah The Almighty Knows Best.

Is it permissible for the man to go out wearing shorts?

It is permissible so long as his Awrah (private part), which is between his navel and knee, is covered. However, the regular wear traditions and modesty are to be observed. And Allah Knows Best

During Ramadan, a man had sexual intercourse with his wife. What is the expiation for that? And is he permitted to pay the expiation?

If a man has intercourse with his wife during the daytime in Ramadan, he must make up for that day and offer expiation. The expiation is fasting for two consecutive months. If he is unable to do so, he must feed sixty needy people. And Allah Knows Best.

Is Zakah (obligatory charity) due on leased property, and how is it calculated?

Zakah isn`t due on the leased property itself, but on the saved income from that property if it reached Nissab (minimum amount liable for Zakah), and a whole lunar year had lapsed over saving it.

I have 490 shares in a commercial company, and they have been held for a year. The price of each share is one dinar, noting that the shares are at a loss. I want to know the amount of zakat due on them?

Commercial shares are subject to zakat based on their current market value, even if they are at a loss. The zakat rate is 2.5%. And Allah Knows Best.

What is the ruling on shaving the head of the newborn?

It is desirable to shave the head of the newborn on the seventh day from delivery, and the weight of his/her hair is given in gold , or silver as charity.
