About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. There is a car dealership, and their method of selling is as follows: The customer pays the full price of the car, the car is registered in their name, and another contract is written in which the company commits to refunding the full price of the car to the customer after one year from the purchase date. What is the Islamic ruling on this transaction?

As for purchasing the car, paying its price, and owning it, this is a valid sale with no issue. However, the condition of refunding the price — whether the car is returned to the seller or not — is an invalid condition that nullifies the entire contract. Therefore, this transaction is invalid and not permissible. And Allah Knows Best.

Which is better, to pray at a prayer place (Musala) whereas many people pray in it, or at a near by mosque in which a few people perform prayer?

Praying at the mosque that has a bigger number is better so long as the number of praying people at the other mosque permits performing prayers in congregation. And Allah Knows Best.

Am I Permitted to Use Ill-gotten Money given to me from Sorcerer's Sons during during my Mother's condolence?

You are permitted to use this money if you were ascertain that the majority of his lawful money surpasses the unlawful one. And Allah Knows Best.

Is it true that whatever is dry is pure even if there was impurity on it?

The impure material object does not soil (make impure) anything else unless the impurity is wet and transferable. But, if the impurity is dry or non-transferable, then there is no problem. Fuqaha has stated that: There is no disagreement between Muslim scholars that when a dry impurity touches something dry it does not make the latter impure.

The relationship between you two is forbidden; however, if he wants to embrace Islam then he should pay a visit to a Sharia court. Once he becomes a Muslim, we will address the matter of proposing to you. And Allah The Almighty Knows Best.

I`m a building contractor. I have been building a house for a client, but the construction process stopped for some reason. Unfortunately, currently, prices of materials have multiplied, is it allowed for me to demand an increase in the agreed price?

It is more appropriate to approach the client and try to reach a mutually satisfactory solution. And Allah The Almighty Knows Best.

If the imam does not leave time for reciting Surah Al-Fatihah, is the recitation of Al-Fatihah waived for the follower?

The recitation of Al-Fatihah is not waived for the follower. They should recite it silently, even if it causes a slight delay in following the imam in bowing (Ruku'). And Allah Knows Best.

Is it permissible for the guardian to give Sadaqa (voluntary charity) from the money of the orphans?

It is impermissible for the guardian to donate from the money of the orphans because he is entrusted with the safekeeping of that money, and is prohibited from donating it.
