About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. It was found out that a man divorced his wife for the third time in 2005, but they continued cohabiting as man and wife. However, when they realized that what they were doing was unlawful, they came the Iftaa` Department in 2009 and were told that they can`t be together. What is the position of Sharia on this couple?

Her Iddah* period starts after the third divorce. As for the continued cohabitation, it is unlawful because being ignorant about the rulings of Sharia while in Dar Al-Islam* is no valid excuse. If a baby came as the fruit of this unlawful consummation of marriage, then a judge of Sharia has the final say in this regard because lineage is a serious matter. And Allah The Almighty Knows Best.

* ʿIddah: a specified period of time that must elapse before a Muslim widow or divorcee may legitimately remarry. The Qurʾān (Sura,2/verse,228) prescribes that a menstruating woman have three monthly periods before contracting a new marriage; the required delay for a nonmenstruating woman is three lunar months.

* Dar Al-Islam: designates a territory where Muslims are free to practice their religion, though this often implies the implementation of Islamic law, whereas Dar al-Harb represents those lands ruled by non-believers

What is the ruling on a person who broke the fast a day in Ramadan due to hardship?

He/she is obliged to make up that day.

All the children of the woman who had suckled a strange child are considered his/her brothers and sisters.

Which is better, to pray at a prayer place (Musala) whereas many people pray in it, or at a near by mosque in which a few people perform prayer?

Praying at the mosque that has a bigger number is better so long as the number of praying people at the other mosque permits performing prayers in congregation. And Allah Knows Best.

Who are the blood-relatives with whom kinship ties should be maintained?

Blood-relatives are those from the side of one`s father and mother: grandfathers, grandmothers, uncles, and aunts. And Allah Knows Best.

What is the ruling on making a false oath?

Making false oath indulges its maker in Hell; therefore, he is obliged to repent, ask Allah for forgiveness and make an expiation; feeding 10 poor or providing clothes for them and in case of incapability of doing any of latters he should fast for 3 consecutive days. And Allah Knows Best.
