About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. The judge seeks the mufti's assistance in solving social problems, just as the mufti refers to the judge matters which are not within the mufti's jurisdiction and which require evidence and witnesses....

Is prayer mandatory on a dying person who goes through a state of unconsciousness, then wakes up?

If he wakes up and was conscious, then he should pray the way/manner he could, but if he wasn't, then he is exempted from obligatory prayer as Allah Says in this regard (What means): "On no soul doth God Place a burden greater than it can bear." [Al-Baqarah/286].

Is the Aqeeqa due on the newborn in case of dying almost a month after the delivery?

Offering Aqeeqa after a week of a newborn death is recommended.

What is usually said upon the slaughtering of the Aqeeqah (the sheep slaughtered on the seventh day from the child`s birth)?

It is desirable to say: "Bismillah Alrahman Alraheem, was`salatu Wa s`salamu Ala Sa`idenah Mohammad, O Allah, this Aqeeqah is from You and to You on behalf of ….."

Is Zakah (obligatory charity) due on the Zakah money received by a poor person, and reached a Nissab (minimum amount liable for Zakah), and a whole lunar year had lapsed over having it in his possession?

Yes, the poor who possessed a Nissab for a whole lunar year is obliged to pay the Zakah due on that money even if it was given to him as a Zakah money in the first place. And Allah Knows Best.

What is the ruling on smoking?

All Perfect Praise is due to Allah, The Lord of The Worlds

Smoking is forbidden (Haram) since it is harmful to one`s health as confirmed by trustful physicians, and Islam has forbidden taking anything that causes harm. The Prophet (PBUH) said: "There should be neither harm nor reciprocated harm." [Ibn Majah and Ahmad]. And Allah Knows Best.

I placed my hand on the Quran and made an oath to avoid doing a specific matter, but the devil seduced me. What is the ruling on this?

You are obliged to pay an expiation; feeding 10 poor and the cost of feeing one is half JD. And Allah Knows Best.

Is it permissible for a person who hasn`t made ablution to call for prayer (Adhan)?

All perfect praise be to Allah, The Lord of The Worlds. It is disliked for a person with a minor impurity to call for prayer, but if he does , then it`s valid and sufficient. And Allah Knows Best.

Has Islam made it incumbent on us to give our children particular names?

No, it hasn`t, but it is desirable that we give them good names.
