About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. My father passed away, and he had life insurance with "Alico" for an amount of 12,500 dinars. He had paid premiums totaling 2,000 dinars. The insurance company paid us the insured amount. Should we take it, or is it considered forbidden (haram) money? And what should we do with it if it is forbidden?

You may take the amount your father paid to the company. The remaining amount is not yours. However, if you must take it, then accept it and donate it to the poor. And Allah Knows Best.

Is it permissible to offer Salah (prayer) on behalf of the sick who is on his/her death bed, and is incapable of offering it?

It`s impermissible to offer Salah on behalf of the sick, or the dead.

Should nail polish be removed before making ablution?

Yes, it should be removed because it prevents water from reaching the nails.

Is it permissible for a financially capable woman to pay the Zakat to her sons or one of them?

It is permissible for a mother to give her children from zakat if they are eligible to receive it, even though she is obligated to provide for them. This is based on the saying of the Prophet Muhammad (PBUH) regarding Zainab, the wife of Abdullah Ibn Mas'ud (may Allah be pleased with them): "Your husband and your children are more deserving of your charity" [Al-Bukhari]. And Allah Knows Best.

Is the prayer of a woman who is led by an Imam via T.V. permissible?

All perfect praise be to Allah, The Lord of The Worlds, and may His Peace and Blessings be upon our Prophet Muhammad and upon all of his family and companions. Amongst the conditions for the validity of prayer is that both the Imam and those led by him must be in the same place. Thus, the prayer of the person who is being led by a televised Imam is invalid unless he/she was with him in the same mosque. And Allah Knows Best.

Is it incumbent on the fiancée to obey her fiancé?

When the woman settles in her husband`s house, it is incumbent on him to provide for her and it is incumbent on her to obey him. Before that, and if the marriage contract had been concluded, then she is lawfully his wife and thus she should abide by custom in treating him, but if the marriage contract hadn`t been concluded, then she should treat him as a non-Mahram (Marriageable).

Is it permissible to say: "O Allah, by the status of the saints and the righteous, and our master Muhammad, peace be upon him, grant us the ability to reach Ramadan"?

What is mentiond by the righteous predecessors that they used to say: "O Allah bless us in Shaba'an and Rajab and give us the ability to reach Ramadan." [Shoa'ab Al-Iman/vol.3/pp.375]. And Allah Knows Best.

I placed my hand on the Quran and made an oath to avoid doing a specific matter, but the devil seduced me. What is the ruling on this?

You are obliged to pay an expiation; feeding 10 poor and the cost of feeing one is half JD. And Allah Knows Best.
