The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. My mother is 70 years old and wishes to perform Hajj and Umrah, as she has never done so before. However, she also takes care of my ill father and is afraid of falling ill herself. What should she do?

If this is the obligatory Hajj – meaning she has not previously performed Hajj or Umrah – then it is permissible for her to go even without her husband's approval. However, she must travel with a Mahram (a male guardian) or a trustworthy group of women, and she should leave someone to care for her husband and attend to his needs. And Allah Knows Best.

I`m getting old and haven`t got married yet. I love wearing the veil, but people advised me to take it off because it could stand in the way of my marriage, and that I should wear it after getting married, what should I do?

The veil (face drape) is the wear of the Prophet`s (PBUH) wives and righteous female companions (May Allah be pleased with them) and whoever imitates a certain group of people shall receive the same reward or punishment like themselves. Only those who are religiously poor deny women wearing the veil, and thinking that it stops a woman from getting married is from the evil suggestions of the devil.

Is it forbidden for a woman to dye her hair?

Praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

It is permissible for a woman to dye her hair with other than black; however, the dye shouldn`t prevent water from reaching the roots of the hair. And Allah The Almighty Knows Best.

By slip of the tongue, my son cursed Allah. It is worth pointing that he has concluded his marriage contract recently, but haven`t consummated the marriage. What is the position of Sharia on this?

This person must return to the fold of Islam by uttering the two testimonies of faith and making repentance to Allah from all acts that lead to disbelief. Also, he must make a new marriage contract because the old one was dissolved after he had committed this act of disbelief. Moreover, since there is no waiting period for his wife, then she is in state of Talaq ba`en baynona Soghra (Minor irrevocable divorce); consequently, she can get back to him only by a new marriage contract. And Allah The Almighty Knows Best.

The General Iftaa` Department celebrates along with all Jordanians the Anniversary of the Royal Accession to the Throne and takes pride in all the gains achieved since the founding of the kingdom until now. A man has married a second wife and deprived the first from provision and overnight stay. He spent most of his time and wealth on his second wife. After sometime, the latter got sick and was diagnosed with breast cancer, which made him forsake her in bed and return to his first wife. What is the position of Sharia on this?

It is forbidden for a woman to forsake her husband in bed without a lawful excuse since this is one of the mutual rights of spouses. When the wife abstains from making love to her husband without a lawful excuse, she is considered sinful. This is because the Prophet (PBUH) said: "If a woman spends the night deserting her husband's bed (does not sleep with him), then the angels send their curses on her till she comes back (to her husband)." [Agreed upon]. And Allah The Almighty Knows Best.

Is the Central Bank of Jordan considered of the Commercial Banks?

Yes, since the Central Bank involves with usury.

I see horrible dreams although I perform the prescribed prayers, what do you make of that?

If a father stops his daughter from getting married, is it permissible for her to conclude the marriage contract herself?

It is permissible for the father to stop his daughter from getting married if there was a lawful reason for that, and she isn`t allowed to conclude the marriage contract without her guardian. However, if her father denied her right in getting married for an unlawful reason, then she should go to court.
