About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. My father passed away, and he had life insurance with "Alico" for an amount of 12,500 dinars. He had paid premiums totaling 2,000 dinars. The insurance company paid us the insured amount. Should we take it, or is it considered forbidden (haram) money? And what should we do with it if it is forbidden?

You may take the amount your father paid to the company. The remaining amount is not yours. However, if you must take it, then accept it and donate it to the poor. And Allah Knows Best.

What is the ruling on a Muslim who slaughters an animal while being in a state of Janabah (ritual impurity)?

All Perfect Praise be to Allah, The Lord of The Worlds, and may His Peace and Blessings be upon our Prophet Muhammad and upo all of his family and companions.

Slaughtering is permissible for the ritually impure man and the menstruating woman because ritual purity isn`t a condition for the validity of the slaughtering. Moreover, it is permissible for the uncircumcised person to do the slaughtering as well. And Allah The Almighy Knows Best.

Should one who doesn`t perform prayer out of laziness make it up later, and how should he/she do so?

All perfect praise be to Allah,The Lord of The Worlds He/she is obliged to make up missed prayers by offering with each obligatory prayer another one, and if he/she offers two, then it is better. And Allah Knows Best.

Is the son of the sister by breastfeeding considered a mahram in Islam, and is it permissible for a woman to go for Hajj with him?

Everything that is prohibited by lineage is also prohibited by breastfeeding. The son of the sister by breastfeeding is considered a mahram, just like the son of the sister by blood, and it is permissible for him to be her mahram for Hajj and Umrah. And Allah Knows Best.

The General Iftaa` Department celebrates along with all Jordanians the Anniversary of the Royal Accession to the Throne and takes pride in all the gains achieved since the founding of the kingdom until now. It takes this opportunity to congratulate His Majesty King Abdullah II on the twentieth anniversary of his accession to the throne. In the meantime, it stresses that it is the duty of every citizen to preserve and take part in the advancement of our country at all levels.

Moreover, the Iftaa` Department confirms that it hasn`t recently issued a statement regarding patriotic songs and calls on media to avoid using the religion for unprofessional incitement during such significant national occasions.

Is it permissible for us to sever ties of kinship if our blood-relatives` gatherings/meetings involve acts of sin?

Observing kinship ties is obligatory, and paying your blood-relatives a visit causing their sinful acts to be hindered , then you should do so. However, if their sinful acts continue while you are at their gathering and they didn't respond positively, then observing kinship ties via telephone and the like will suffice in this case. What is the ruling of Sharia on unregistered marriage in Jordan?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

Aishah narrated that the Messenger of Allah said: "Whichever woman married without the permission of her Wali her marriage is invalid, her marriage is invalid, her marriage is invalid. If he entered into her, then the Mahr is for her in lieu of what he enjoyed from her private part. If they disagree, then the Sultan is the Wali for one who has no Wali." [At-Tirmithi, Hadith No.1102]. The Prophet (PBUH) also said: "There is no marriage without a guardian and two honorable witnesses." Related in [Al-Mo`jam Al-Basit for At-Tabarani, pp.6366]. Registration of the marriage contract at Islamic court is necessary for the preservation of rights and failing to do so is punishable by Jordanian Law. And Allah The Almighty Knows Best

What is the ruling on the existence of cattles' marketplace of (Sheeps, cows and chickens ) inside a graveyard?

Graves must be respected, and it is not permissible to sit on them or show any disrespect. Establishing a marketplace within a cemetery is undoubtedly a form of disrespect to the deceased and is not permissible. Such actions should not be tolerated. And Allah Knows Best.

Is it permissible for a young man and a young woman to enter into a covenant as a married couple without having a true seclusion (Khalwah) until their marriage contract is officially concluded?

The relation which isn`t based on a marriage contract is forbidden, and entering into a covenant as a married couple is unaccounted for and is from the evil suggestions of the devil.
