Resolution No.(39): "Ruling of Sharia on Bahaism"

Date: 25/6/1417 AH, corresponding to 7/11/1996

 

The Board has received the following question: 
What is the ruling of Sharia on Mr. (X`s) request to obtain a family register for the first time, taking into consideration the fact that he embraces Baha'ism?
Answer: All prefect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.
The Board is of the view that it isn`t permissible to register the religion of the above mentioned person in his family register or passport because the Hashemite Kingdom of Jordan doesn`t recognize "Baha'ism" and any Muslim who converts to it is considered an apostate and takes the rulings of Sharia on apostates. Moreover, in the official records and documents he remains a Muslim based on his father`s family register until a Sharia court rules that he is an apostate. And Allah Knows Best.

Although engaged to be married, a man committed adultery with another woman. What is the ruling of Sharia on this?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
 
There is no sin on the woman to whom this man is engaged; however, he is considered a cheater and must receive the punishment prescribed in Sharia. And Allah The Almighty Knows Best.

Is Zakah due on the orphan`s money?

Yes, Zakah is due on the money of the orphan.

My mother is 70 years old and wishes to perform Hajj and Umrah, as she has never done so before. However, she also takes care of my ill father and is afraid of falling ill herself. What should she do?
 
 
 
 
 
 

If this is the obligatory Hajj – meaning she has not previously performed Hajj or Umrah – then it is permissible for her to go even without her husband's approval. However, she must travel with a Mahram (a male guardian) or a trustworthy group of women, and she should leave someone to care for her husband and attend to his needs. After Allah grants you complete healing, make up the prayers you performed with your finger to the best of your ability, at times that suit you. And Allah Knows Best.
