قرار رقم: (290) (10 / 2020) ورقة موقف الأردن حول الإجهاض

بتاريخ (29/شوال/1441هـ) الموافق (21 / 6/ 2020م)

 

الحمد لله رب العالمين، والصلاة والسلام على سيدنا محمد، وعلى آله وصحبه أجمعين، وبعد 

فإن مجلس الإفتاء والبحوث والدراسات الإسلامية في جلسته التاسعة المنعقدة يوم الأحد (29/شوال/ 1441هـ)، الموافق (21/ 6 / 2020م) قد نظر في الكتاب الوارد من دولة رئيس الوزراء د. عمر الرزاز حيث جاء فيه: في ضوء الحديث الذي دار في جلسة مجلس الوزراء المنعقدة بتاريخ (4 /2 /2019) أثناء مناقشة توصية لجنة الخدمات والبنى التحتية والشؤون الاجتماعية الصادرة عن جلستها المنعقدة بتاريخ (14 /1 /2019) المتعلقة بـ "ورقة موقف الأردن حول الإجهاض" -والمرفق صورة عنه-، أبعث إليكم بصورة عن التوصية أعلاه ومرفقاتها المتعلقة بالموضوع ذاته، للدراسة وبيان الرأي. واقبلوا فائق الاحترام.

وبعد الدراسة ومداولة الرأي قرر المجلس ما يأتي: 

ما جاء في الفقرات المرفقة بعنوان "ورقة موقف/ حول الإجهاض في الأردن" موفق ومنسجم مع الاجتهادات الفقهية المتعلقة بحكم الإجهاض التي روعيت فيها المقاصد الشرعية.

ونوصي بضرورة إجراء بعض التعديلات التي نراها مهمة لاستكمال الرأي الشرعي في الورقة، وهي على النحو الآتي:

أولاً: ورد (ص5) ما نصه: "التوعية من العلاقات غير الشرعية وغير الآمنة لدى جميع فئات المجتمع".

نرى تعديل كلمة "التوعية" لتصبح "التحذير"، وتعديل كلمة "غير الشرعية"، و"غير الآمنة" حيثما وجدت إلى: "العلاقات خارج إطار عقد الزوجية الصحيح".

ثانياً: في (ص5) الحديث عن "إدراج التربية الجنسية".

نرى إضافة عبارة "بما لا يتعارض مع قيمنا المجتمعية ومبادئ الشريعة الإسلامية".

ثالثاً: نرى ضرورة إضافة دائرة الإفتاء العام ضمن جهات التنفيذ في فقرة "إدراج التربية الجنسية" وفقرة "نشر الوعي الديني".

رابعاً: ورد (ص5) ما نصه: "الإسراع في فتح عيادات متخصصة للصحة الإنجابية لفئة الشباب ذكورا وإناثا...الخ".

نرى ضرورة تقييدها بعبارة: "بما لا يتعارض مع قيمنا المجتمعية ومبادئ الشريعة الإسلامية".

خامساً: ضرورة إضافة عبارة "بتنسيب من الجهات المختصة" في الهامش رقم/12 المتعلق بنظام تشكيل لجنة الأخلاقيات الطبية. والله تعالى أعلم.

What is the ruling of Islamic Law on following the actions of the imam in prayer and how this following is achieved?

Praise be to Allah, and peace and blessings be upon our master, the Messenger of Allah.
The follower (ma'mum) is required to follow his imam in the actions of the prayer. This "following" (mutaba'ah) means that the follower performs each action of the prayer after the imam has begun it but before he has finished it. For example, the follower bows (in ruku') after the imam has reached the position of bowing, then rises after the imam has risen. The Prophet, peace and blessings be upon him, said: "The imam is only appointed to be followed, so when he says the takbir, say the takbir; and when he bows, then bow; and when he prostrates, then prostrate" (agreed upon, i.e., reported by both al-Bukhari and Muslim).
It is stated in Mughni al-Muhtaj (1/505): "Among the conditions of valid congregational prayer (iqtida') is following the imam in the actions of the prayer... meaning that following the imam is obligatory in the physical actions of the prayer, not in its verbal utterances... Complete following (kamal al-mutaba'ah) is achieved when the follower's beginning of an action comes after the imam's beginning of that same action, while the follower's beginning of the action precedes the imam's completion of it" — end of quote, with slight paraphrasing.

What is the ruling on using eye drops while fasting?

Eye drops do not break the fast, even if the taste reaches the throat, because the eye is not an open passage to the body cavity.

What is the ruling on bypassing a nearby mosque for a distant one?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
If a distant mosque has a larger congregation (Jama‘ah) while the congregation in the nearby mosque is smaller, and the congregation in the nearby mosque is not adversely affected by the worshiper's absence, then it is better for him to pray in the distant mosque with the larger congregation. However, if the congregation in the nearby mosque would be affected by his absence—such as if he is its Imam, or if his presence encourages others to attend—then praying in the nearby mosque is better. This ensures that the congregation is established in two different locations within the community. This is based on the saying of the Prophet ﷺ: 'A man's prayer offered with another man is purer than his prayer which he offers alone, and his prayer with two men is purer than his prayer with one and if they are more (in number), it is more beloved to Allah, the Mighty the Majestic' (Narrated by Ahmad, Abu Dawood, and An-Nasa'i). And Allah the Exalted knows best.

What is the ruling on a mother giving the Zakat of her wealth to her children?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
It is permissible for a mother to give her children from the Zakat if they are among those who are eligible for it—such as being poor (Fuqara), possessing no wealth, and not being sufficiently provided for by the maintenance (Nafaqah) of others. This is based on the statement of the Messenger of Allah ﷺ regarding Zaynab, the wife of 'Abdullah ibn Mas'ud (may Allah be pleased with them both): (Your husband and your children are the most deserving of those upon whom you spend in charity) [Narrated by Al-Bukhari].
 
It is stated in [Al-Hawi al-Kabir, Vol. 8/P.537]: 'As for the wife, it is permissible for her to pay her Zakat to her husband from all the designated shares... Our evidence is the generality of the saying of Allah the Almighty: "Zakat expenditures are only for the poor and for the needy", and the Hadith of Abu Hurairah that the Prophet ﷺ said to Zaynab, the wife of 'Abdullah ibn Mas'ud: (Your husband and your children are the most deserving of those upon whom you spend), and this is taken in its general sense.' And Allah the Exalted knows best.
