Resolution No.(273): "Ruling on Funds Donated to the Educational Endowment"

"Ruling on Funds Donated to the Educational Endowment"

Date: (30/ Jumādā al-Akhira/1440 AH), corresponding to (7/3/2019)

 

 

All perfect praise be to Allah, the Lord of the Worlds.

 

During its third session held on the above date, the Board reviewed the letter (No.2/3/2019 AH) sent to the Iftaa` Department from the counsellor of the Educational Endowment. In that letter, he pointed that the Endowment receives both in kind and cash donations, adding that some people stipulate that their donations be spent on maintaining schools while others on laboratories, desks, and other equipment. It is worth pointing that the main objective of the Endowment is building schools in favor of the Ministry of Education. What is the ruling of Sharia on this?

 

After deliberating, the Board arrived at the following decision:

 

Funds donated without defining the channel they should be spent in favor of are, in principle, endowed funds, because, basically, what is donated to an officially registered endowment must be spent in favor of the purpose for which it was established in the first place. Therefore, it is permissible that you accept and spend these donations in accordance with the rules of the endowment. This is along with ensuring schools` adherence to these rules and keeping them (schools) under constant supervision.

 

As for the funds for which the donor specifies a certain channel, they are to be spent as he stipulated, be that for maintenance, furniture, tools and the like. This is because the Sharia rule, in this regard, states: "The conditions set by the endower (Waqif) are as binding as the provisions of Sharia."

As for the wages of maintenance workers and consumed materials, it isn`t permissible to spend the money of the endowment on these alone. Rather, the endowment can allocate a fund for public charities and donations where it informs donors, upon making the donations, about the purpose for which that fund is established. This is in order for them (donors) to understand the difference between endowment and charity in general. Upon achieving that, there is no harm in spending the funds of public charity in favor of the various forms of maintenance. And Allah the Almighty Knows Best.

It is obligatory upon a Muslim to uphold honesty in both his words and his actions. Allah the Almighty says {what means}: "O you who have believed, do not betray Allah and the Messenger or betray your trusts while you know." [Al-Anfāl/ 27] And He says {what means}: "O you who have believed, fear Allah and be with the truthful." [Al-Tawbah/ 119]. And the Messenger of Allah ﷺ said: "Whoever deceives us is not of us." (Reported by al-Bukhārī.)
As for creating a new account for the same buyer, the terms and conditions of the website must be observed and respected. If doing so violates those terms, it is not permissible. And Allah the Almighty knows best.

What is the ruling of Islamic Law on wearing energy stones?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
There is no objection to a woman adorning herself with precious and semi-precious stones — such as ruby, carnelian, or the like — so long as these are stones that women customarily wear as adornment.
As for what are known as "energy stones," if they are used with the intention of seeking remedy and healing, then such matters are governed by experimentation and scientific study — which either establishes that they have a tangible effect or does not — and all of this operates by the permission and will of Allah, Glorified and Exalted. If studies or practical experience do establish that such stones carry a beneficial effect upon human health, then there is no objection to using them. They are, after all, part of Allah's creation, much like medicinal substances extracted from plants or derived from other created things — provided that the Muslim does not believe that the stone itself is the source of benefit or harm. It is nothing more than a means among the many means that Allah has placed in this world, and the reality of all affairs belongs to Allah alone. And Allah the Almighty knows best.

What is required of one who doubts the number of rakʿāt during prayer?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
If a person doubts the number of rakʿāt he has prayed, he should build upon the lesser number, as that is what he is certain of. He should then perform the prostration of forgetfulness (sujūd al-sahw) before the final salām at the end of the prayer. ʿAṭāʾ ibn Yasār narrated that the Messenger of Allah ﷺ said: "When any one of you is in doubt during his prayer and does not know whether he has prayed three rakʿāt or four, let him pray one more rakʿah and then perform two prostrations while seated before the salām. If the rakʿah he prayed was a fifth, these two prostrations will make it even; and if it was the fourth, then the two prostrations serve as a humiliation for the devil." (Reported by Abū Dāwūd.)
It is stated in al-Muqaddimah al-Ḥaḍramiyyah — one of the foundational texts of the Shāfiʿī school: "If one doubts whether he has prayed three rakʿāt or four, he is obliged to build upon the lesser number."
However, if such doubt recurs repeatedly and reaches the level of obsessive whispering (waswasah), he should not build upon the lesser number in that case — rather, he should build upon the greater number. And Allah the Almighty knows best.

Is it incumbent on a father to cover the marriage costs of his son if the latter couldn`t afford them?

The son should seek the help of his relatives in order to convince his father to do the aforesaid, and the father should make sure that his son doesn`t commit fornication through helping him to get married, and Allah will reward him for doing so.
