قرار رقم: (230) (14/ 2016) شرعية الاتفاقية العربية لتنظيم زراعة الأعضاء والأنسجة البشرية ومنع  الاتجار بها

بتاريخ (22/ربيع الأول/1438هـ)، الموافق (22 /12 /2016م)

الحمد لله رب العالمين، والصلاة والسلام على سيدنا محمد، وعلى آله وصحبه أجمعين، وبعد

فإن مجلس الإفتاء والبحوث والدراسات الإسلامية في جلسته الثانية عشرة المنعقدة يوم الخميس (22/ربيع الأول/1438هـ)، الموافق (22 /12 /2016م) قد اطلع على السؤال الوارد من معالي وزير الأوقاف والشؤون والمقدسات الإسلامية الدكتور وائل عربيات، حيث جاء فيه:

أرفق بطيه مذكرة الأمانة العامة لجامعة الدول العربية رقم (3/2984) تاريخ (12 /10 /2016م) والمرفق بها التقرير والتوصيات الصادرة عن الاجتماع السادس للجنة وممثلي وزارات العدل والداخلية والصحة والشؤون الدينية الرسمية في الدول العربية لإعداد مشروع الاتفاقية العربية لتنظيم نقل وزراعة الأعضاء والأنسجة البشرية ومنع ومكافحة الاتجار فيها. أرجو سماحتكم التكرم بالإيعاز لبيان الرأي الشرعي حول بنود الاتفاقية المذكورة. وبعد الدراسة ومداولة الرأي قرر المجلس ما يأتي:

في ضوء ما تقرر من وجوب المحافظة على كرامة الإنسان وصيانتها عن كل اعتداء أو امتهان، وما قرره مجلس الإفتاء والبحوث والدراسات الإسلامية في قراراته السابقة، وما صدر عن المجامع الفقهية في العالم الإسلامي، لم يجد المجلس في بنود الاتفاقية المذكورة محذورًا شرعيًا يستدعي التوقف فيها. والله تعالى أعلم

What is the ruling on a woman who takes medication to delay menstruation for fasting?

If a woman takes medication (to delay menstrual period) and does not experience menstruation, her fast is valid. However, she is not advised to do so unless there is a necessity.
If the medication harms her, even potentially, it is forbidden (haram) for her to take it.

What is the ruling on mentioning Allah`s name upon slaughtering an animal?

In the Name of Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
 
It is a Sunnah (prophetic tradition) for the person slaughtering to say: "Bismillah" (In the Name of Allah), though the most complete and perfect phrasing is to say: "Bismillah ar-Rahman ar-Rahim" (In the Name of Allah, the Most Gracious, the Most Merciful). This is in accordance with the words of Allah Almighty: "So eat of that [meat] upon which the name of Allah has been mentioned." (Al-An'am/118)
 
However, pronouncing it is not an obligatory requirement (Wajib). If someone omits it—whether deliberately or out of forgetfulness—the meat remains entirely lawful (Halal) to eat, though purposely omitting it is considered disliked (Makruh). And Allah the Almighty Knows Best.

What is the ruling of Islamic Law on continuity (muwalah) in the ritual bath?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
Continuity (muwālāh) means washing each part of the body immediately after the previous one, without leaving a gap long enough for the first part to dry before the second is washed. According to the Shāfiʿī school, continuity is a recommended act (sunnah) in both the ritual bath (ghusl) and ablution (wuḍūʾ) — it is not obligatory.
It is stated in Nihāyat al-Muḥtāj ilā Sharḥ al-Minhāj: "Likewise, continuity in the ritual bath is recommended, just as it is in ablution."
Accordingly, continuity in the ritual bath is a sunnah. And Allah the Almighty knows best.

What are the signs of Laylat al-Qadr?

It is said that among its signs are:
● A sense of peace and tranquility during the night.
● The sun rises on the following morning white and without strong rays.
However, one should not be preoccupied with searching for its signs at the expense of worship. Allah has hidden its exact date so that we strive in worship throughout multiple nights, ensuring that we attain its great reward.
