Resolution No.(228): "Ruling on Distributing Donations that haven`t Reached their Destination"

Resolution No.(228)(12/2016) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Distributing Donations that haven`t Reached their  Destination"

Date: (8/Thulghidah/1437 AH), corresponding to (11/8/2016 AD).

 

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

During its tenth session held on the above date, the Board reviewed the question of the Secretary-General of the Vocational Syndicates Complex , and it reads as follows:

Out of solidarity with the people of Gaza in the aftermath of the latest Israeli aggression against them, the Vocational Syndicates have launched fundraising campaign in their favor. As a result, many  projects have been executed in cooperation with the Jordan Hashemite Charity Organization (JHCO) such as: caravan houses, clothes for children, stationery, medical supplies, and the like. The latest of these projects was purchasing winter clothes for the children with a sum of (100,000)JDs. from the donations dedicated to the strip. In fact, these were sent in lorries after coordinating with the (JHCO); however, the Israeli authorities allowed a third into the strip and returned the rest. This is what we have been told by the (JHCO) who also told us that resending this shipment is impossible because the Israeli occupation could ban delivering any type of aid in the future. Moreover, it is also hard to keep these items at the warehouse of the (JHCO) for long; therefore, could you tell us the ruling of Sharia on redistributing these items amongst the poor and needy in the Hashemite Kingdom of Jordan?

After deliberating, the Board decided the following:

There is no harm that the (JHCO) distributes these items amongst the poor and needy in Jordan since donations and charities should be spent in the channel for which they have been raised in the first place. If that wasn`t possible, then they should be spent in a similar channel, for Allah, The Almighty, Says (What means): "Allah tasketh not a soul beyond its scope." {Al-Baqarah/286} and " for God suffereth not the reward to be lost of those who do good;" {At-Tawbah/120}. In addition, the Prophet (PBUH) said: "You will be rewarded for what you intended" {Musnad Ahmad}. And Allah Knows Best.

What is the ruling on performing ablution (wudu') and ritual bathing (ghusl) with Zamzam water?

It is permissible to perform ablution and ritual bathing with Zamzam water. However, scholars disliked using it for cleaning after relieving oneself (istinja'). And Allah the Almighty knows best.

"I told my family at night: 'I will fast tomorrow as qaḍā' (a make-up fast),' but I forgot to make the intention before sleeping. Is my fast valid?"

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah ﷺ.
 
The intention is obligatory in acts of worship. For obligatory fasting, the required intention is to resolve to fast during the night [before dawn]. Its proper locus is the heart, while verbalizing the intention out loud in acts of worship is a sunnah — so that the tongue may align with the heart. If the intent behind the statement in question was the intention to fast, then it is valid; but if the intent was merely to inform someone, or reflected hesitation or doubt, then it is not valid.
 
It is stated in *Bushrā al-Karīm* (Vol.1/P.216): "It is a sunnah to verbalize the intention — that is, whatever has already been intended in the heart, whether an obligatory or a voluntary act — such as specifying the number of rak‘ahs, just before the opening takbīr — so that the tongue may assist the heart, and because this is further removed from whispered doubts (waswasah), and in order to accommodate the view of those who held it obligatory in every act of worship that requires an intention (even though this is a minority position), by analogy with Ḥajj."
 
Accordingly: if the intention to fast arose in your heart before the second adhān [i.e., before Fajr], then your fast is valid.

What is the ruling on a woman using contraception without her husband's knowledge if he is mistreating her?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
It is not permissible for a woman to use any means of delaying pregnancy without her husband's knowledge, consent, and mutual agreement. This is because having children is a sharʿī right belonging to both spouses equally in Islamic law. Imām al-Māwardī, may Allah have mercy upon him, stated: "The right to a child from a free woman is shared between them both" — meaning between the two spouses. [al-Ḥāwī al-Kabīr, 9/320]
It is therefore not permissible for either spouse to make a unilateral decision regarding the prevention of pregnancy without the consent of the other. We advise both spouses to discuss the matter with wisdom and mutual respect, so as to resolve any disagreement and arrive at a suitable solution that serves the interests of them both. And Allah the Almighty knows best.

Is it permissible for the mother to give her children from the Zakah (obligatory charity) of her money?

It is permissible for the mother to give her children from the Zakah of her money if they are Zakah-eligible recipients, and she isn`t obliged to provide for them.
