Resolution No.(178): "Ruling of Sharia on Deducting Part of the Donations to Cover Administrative Expenses"

Date Added : 02-11-2015

Resolution No.(178)(10/2012) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling of Sharia on Deducting Part of the Donations to Cover Administrative Expenses"

Date: 8/8/1433 AH, corresponding to 28/6/2012.

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

During its fifth session held on the above given date, the Board reviewed the following question:

From time to time, the Professional Associations Complex launches fund-raising campaigns to support the poor in Jordan, or our Arab brothers. Since such campaigns involve administrative expenses, is it permissible to cover them from the raised-funds?

After researching and deliberating, the Board decided what follows:

There are two types of administrative expenses needed by charitable societies:

First: Administrative expenses that are essential for achieving the objective of the fund-raising campaign, such as expenses of delivering funds to their eligible recipients, the expenses of safeguarding these funds and the like, are permissible to be covered in compliance with the agreed upon jurisprudential maxim: "The means takes the ruling of the end.". This maxim has been indicated by many of the Sharia-approved evidences, and was stated in many books of the scholars, such as Al-Izz Bin Abdulsalaam.

Second: Other administrative expenses of the society, such as staff salaries, rent, water, electricity..etc, shouldn`t be covered from the funds that have been raised for a certain purpose; rather, from the general donations made to the society in general, or for it in particular.

To be on the safe side, the Board advises those in charge of raising these funds to inform the donors that a small part of them covers administrative expenses. And Allah Knows Best.

Summarized Fatawaa

Is it permissible to consume the meat of a sacrifice (Dhabihah) offered as an act of devotion to Allah, seeking His protection for my family?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

It is permissible to eat from this sacrifice, and the reward [for it] is according to what is given to the poor. And Allah the Exalted knows best.

Is an elderly or chronically ill person required to pay additional fidyah if they delay it beyond the first year?

An elderly person or someone permanently unable to fast must pay fidyah by feeding one needy person for each missed day.
However, if they delay paying fidyah beyond the first year, no additional fidyah is required.
This differs from someone who delays making up missed Ramadan fasts (qada) without a valid excuse until the next Ramadan begins—such a person is required to pay an additional fidyah for the delay.

What should a person, who doubts the validity of his Wudu, or over performs it, do?

One who doubts the validity of his/her Wudu while performing it should redo it until he/she is certain of having attained purity. But, if doubt was after having performed Wudu, then he/she should not pay attention to that as doubt after the end of an act of worship does not count. This is of course in case doubt was within the reasonable limits since once it goes beyond that, it becomes a whispering of the Shaytaan (devil) which he/she should ignore as the Wudu is valid.

What is the ruling on making up the regular pre-Dhuhr *sunnah* (*al-sunnah al-rātibah al-qabliyyah*) for one who missed it in the Dhuhr prayer?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
Every timed supererogatory prayer (nāfilah) is recommended (mandūb) to be made up if its time passes. As for a nāfilah that precedes the obligatory prayer, performing it before the farḍ is a matter of proper etiquette (adab); if it is prayed after the farḍ, it is still considered adāʾ (performed within its time). If the time of the farḍ has ended, it is recommended to make up (qaḍāʾ) the nāfilah for one who did not pray it.
Whoever misses the sunnah before Dhuhr, whether with an excuse or without one, it is recommended for him to pray it after the obligatory Dhuhr prayer, within the time of Dhuhr, even at its end, and it counts as adāʾ, not qaḍāʾ. It is also recommended for one who missed the pre-Dhuhr sunnah to pray it before the post-Dhuhr sunnah, in observance of the proper order. It is stated in ʿUmdat al-Sālik wa ʿUddat al-Nāsik (Vol.1/p.60): "What precedes the obligatory prayer has the same time as the obligatory prayer, and performing it before the farḍ is a matter of etiquette; after it, it is adāʾ. What follows the farḍ has its time begin with the performance of the farḍ and end with the end of its time."
If the time of Dhuhr has ended, it is recommended for him to pray both the pre- and post-Dhuhr sunnahs, and they count as qaḍāʾ for both. It is stated in ʿUmdat al-Sālik (1/61): "Every timed nafl, such as the ʿĪd prayer, Duha, Witr, and the regular rawātib of the obligatory prayers, if it is missed, it is recommended to make it up forever." And Allah Almighty knows best.
