Resolution No.(151), (16/2010) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Donating Kidneys"

Date: 2/9/1431 AH, corresponding to 12/8/2010 AD.

 

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

During its ninth session held on the above given date, the Board reviewed the following question:

I`m inflicted with kidney failure, so I undergo renal dialysis thrice a week. I have tried so hard to find a cure to this illness but failed. In fact, I have only one son and he offered to donate his kidney, but I refused in fear for his life. However, a doer of charitable actions heard about my problem and expressed his willingness to save my life by donating me his own kidney?

Answer:

After prolonged deliberations, the Board decided what follows:

The Board reconfirms its earlier resolution No.(10/2008), 29/11/1429 AH, corresponding to 21/11/2008 AD, which stipulates that kidney donation in this case is impermissible because it violates the provisions of Islamic Sharia. This is in addition to the fact that there are other options, such as renal dialysis and a donor from the patient`s kin. Moreover, the Jordanian Law bans donating kidneys to non-relatives. What is the ruling on paying a sum of money to Saudi citizen in return of having Saudi residence? It is worth noting that this transation is labelled as a "worker's visa" but I am not going to work as such only to facilitate having it?

Allah The Almighty Says (What means): "O you who have believed, fear Allah and be with the truthful" [At-Tawbah/119]. False statements contradict truthfulness, and it is not permissible to write them. A Muslim has the right to live in any Islamic country, and those who prevent him will be accountable before Allah about their action and the justification for the prohibition. And Allah Knows Best.

Is it permissible to fish on Saturday?

All Perfect Praise be to Allah, The Lord of The Worlds, and may His Peace and Blessings be upon our Prophet Muhammad and upon all of his family and companions. 

It is permissible for Muslims to fish on any day, but the sons of Israel are the ones forbidden to fish on Saturday. Moreover, there is no evidence in Islamic Sharia prohibiting Muslims from fishing on that day. And Allah Knows Best.

Is vomit among the nullifiers of Wudu (ablution)?

Vomit does not nullify Wudu, but it is a Najaasah (impurity) that requires rinsing the mouth and washing whatever became dirty by it since the prayer becomes valid only after the removal of Najaasah. And Allah Knows Best.

What should a mensurating woman, or in state of confinement do if she became ritually pure during the daytime of Ramadhan ?

If she became pure during the daytime of Ramadhaan, is desirable to complete her fasting during that day, and to make up for it along with other missed days due to menstruation. And Allah Knows Best.
