Resolution No.(88): “Ruling on Giving Zakat for Building a School“

Resolution No.(88) by the Board of Iftaa`, Research and Islamic Studies:

“Ruling on Giving Zakat for Building a School“

Date: 28/4/1426 AH, corresponding to 8/6/2005 AD.

 

 

 

Question:

 

Are the sums donated by charity givers for building a school considered from the Zakat due on their property?

Answer: All success is due to Allah.

The channels of Zakaah have been set by the Islamic Sharee'ah within the eight categories mentioned in the Quran. Allah The Almighty Says {what means}: “Alms are for the poor and the needy, and those employed to administer the (funds); for those whose hearts have been (recently) reconciled (to Truth); for those in bondage and in debt; in the cause of God; and for the wayfarer: (thus is it) ordained by God, and God is full of knowledge and wisdom.” {At-tawbah/60}.

Moreover, Zyad Ibn Al-Harith Al-Suda`i narrated: “ I came to the Messenger of Allah (PBUH) and swore allegiance to him, and after telling a long story he said: Then a man came to him and said: Give me some of the sadaqah (alms). The Messenger of Allah (PBUH) said: Allah is not pleased with a Prophet's or anyone else's decision about sadaqat till He has given a decision about them Himself. He has divided those entitled to them into eight categories, so if you come within those categories, I shall give you what you desire.” {Abu Dawood}.

Since building the school isn`t within the  categories eligible to receive Zakat, then it is impermissible to consider the sums donated by charity givers for this purpose as Zakat of their property.

What is the ruling on performing the Istikhara prayer after the Witr paryer?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
The Istikhara prayer (Prayer for seeking guidance) is a Sunnah. It consists of two units (rak’ahs) performed outside of the obligatory prayers, after which the person supplicates with the traditionally narrated du’a. It is permissible to perform it before or after the Witr prayer, as the Istikhara prayer is recommended at all times except during the disliked times—the periods in which prayer is prohibited. This is because its specific reason (the Istikhara and supplication) occurs after the prayer itself, and any prayer with a subsequent reason is not permitted during the prohibited times. It should be noted that the two rak’ahs of Istikhara are not fulfilled by performing only one rak’ah, nor by a prostration of recitation (Sajdat al-Tilawah), nor by a funeral prayer (Janazah). And Allah the Exalted knows best.

Is it permissible for a sick person to pray while sitting on a chair?

All perfect praise be to Allah, The Lord of the Worlds                                                                                                                                                                        It is permissible for a sick person, who is unable to stand up, to offer prayer while sitting on a chair. If he/she was unable to prostrate while on the chair, the he/she should pray while sitting on the ground, but if he/she was neither able to bow (Roku),nor to prostrate, then he can do them while sitting on the chair. And Allah Knows Best.

What are the Sharia consequences when the sacrificial time for the uḍḥiyyah comes to an end?

 
 
 
 
 
 

All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
If the sun sets at the end of the last of the Days of Tashrīq and the sacrificial animal (uḍḥiyyah) has not yet been slaughtered, then its prescribed time has elapsed. Should one slaughter it thereafter, it will not be considered a valid uḍḥiyyah.
However, if the sacrifice was vowed (mandhūrah), then it remains obligatory to slaughter it — and it shall be carried out as a make-up (qaḍā') of the vow, with its meat distributed in the rightful channels designated for such sacrifices.
It is stated in Bushrā al-Karīm (p. 702): "If one slaughters after the sunset of the last of the Days of Tashrīq... it isn`t considered a valid uḍḥiyyah, unless it was vowed — in which case it is carried out as qaḍā'."
And Allah Almighty knows best.

What is the ruling on performing dry ablution (tayammum) instead of the ritual bath due to severe cold?

Whoever is sick such that he cannot use water, or finds the water cold and heating it is not possible, and the person would be harmed by using cold water, it is permissible for him to perform tayammum. He must make up what he prayed with tayammum, because this is a place where there is water. And Allah the Almighty knows best.
