Resolution No.(173): "Ruling on Importing Shoes Made from Swine`s Skin"

Resolution No.(173)(5/2012) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Importing Shoes Made from Swine`s Skin"

Date: 25/6/1433 AH, corresponding to 17/5/2012 AD.

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

On the above date, the Board reviewed the question asked by His Excellency, the Director-General of the Jordan Standards and Metrology Organization and it reads as follows: What is the ruling of Islamic Sharia on a company that intends to import shoes made from swine`s flesh?

After prolonged deliberations, the Board decided what follows:

It is forbidden to manufacture shoes, clothes and other products from swine`s skin, as indicated by the following verse: "Say: "I find not in the message received by me by inspiration any (meat) forbidden to be eaten by one who wishes to eat it, unless it be dead meat, or blood poured forth, or the flesh of swine,- for it is an abomination - or, what is impious, (meat) on which a name has been invoked, other than God’s". {Al-An`am/145}.

Interpreters of the Quran stated that the above verse indicates that all the parts of swine are forbidden; however, its flesh was mentioned because it is the most utilized part. A proof of this is the Hadith of Jabir, where swine has been absolutely forbidden. Jabir b. 'Abdullah (Allah be pleased with them) reported Allah's Messenger (PBUH) as saying in the Year of Victory while he was in Mecca:

Verily Allah and His Messenger have forbidden the sale of wine, carcass, swine and idols, It was said: Allah's Messenger, you see that the fat of the carcass is used for coating the boats and varnishing the hides and people use it for lighting purposes, whereupon he said: No, it is forbidden, Then Allah's Messenger (PBUH) said: May Allah the Exalted and Majestic destroy the Jews; when Allah forbade the use of fat of the carcass for them, they melted it, and then sold it and made use of its price (received from it)." {Agreed upon}.

The filthy or impure can`t be made pure by tanning, as stated by the renowned scholar Ibn Abdeen (May Allah bless him), who said: "Because it is filthy as a whole, dead or alive, its filth of blood is unlike that of other animals; therefore, purifying it is unacceptable." {Rad Al-Mohtar}. Al-Imam Al-Khasani (May Allah bless him) said: "The sale of swine`s skin is invalid because it is filthy as a whole." {Bada`I As`sanai`}.

The accredited opinion of the four jurists is that swine is forbidden, and  utilizing from any of its parts is forbidden as well because it is filthy.

Accordingly, the Board of Iftaa` is of the view that it is forbidden to trade with all the products of swine and it advises Muslim traders not to buy what Allah has forbidden and not to bring such filth into the Muslim`s markets. And Allah Knows Best.

What are the Sunnahs and etiquettes related to the slaughtering of an animal?

 

 
In the Name of Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
 
1-Avoid terrifying the animal before it is slaughtered.
 
2-Do not slaughter the animal in front of others of its kind.
 
3-Offer water to the animal before the sacrifice.
 
4-Sharpen the knife thoroughly prior to slaughtering to ensure the cut is made as quickly and cleanly as possible. This is in accordance with the statement of our Master, the Prophet (peace and blessings be upon him): "Indeed, Allah, the Almighty and Majestic, has prescribed excellence (Ihsan) in all things. So when you kill, kill well; and when you slaughter, slaughter well. Let each of you sharpen his blade, and let him put his sacrificial animal at ease." (Narrated by Muslim)
 
Do not begin skinning the carcass until you are absolutely certain that the animal has completely passed away.
 
Slaughter cattle, sheep, and goats while they are lying down on their left side, facing the Qiblah (direction of prayer). Leave the right leg untied so the animal can move it, helping it rest more easily during its final moments. For camels, however, the preferred method (Nahr) is to slaughter them while they are standing up, with their left knee tied. And Allah the Almighty Knows Best.

Is vomit among the nullifiers of Wudu (ablution)?

Vomit does not nullify Wudu, but it is a Najaasah (impurity) that requires rinsing the mouth and washing whatever became dirty by it since the prayer becomes valid only after the removal of Najaasah. And Allah Knows Best.

Is an animal that results from crossbreeding between two types of livestock (an'ām) valid [for sacrifice]?

Praise be to Allah, and peace and blessings upon our master, the Messenger of Allah.
An animal that results from crossbreeding between two types of livestock (an'ām) is valid [for sacrifice], with consideration given to the higher of the two required ages. Thus, in the case of an animal crossbred between sheep (ḍa'n) and goats (ma'z), only one that has reached two years of age is valid [for sacrifice]. And Allah, the Most High, knows best.

What is the ruling of Islamic Law on leaving the Sunnah prayer of Dhuhr due to fatigue?

Praise be to Allah, and peace and blessings upon our master, the Messenger of Allah.
According to the general rule, a Muslim should strive to maintain the Sunnah prayers before and after the obligatory prayers (al-sunan al-qabliyyah wa al-ba'diyyah). One is permitted to pray them sitting from the outset, but if one leaves them due to severe fatigue, there is no objection to doing so. It is recommended (mustahabb) to make up (qadā') a time-bound supererogatory prayer (nafl mu'aqqat) at any time if it was missed.
Al-Shirbīnī (may Allah have mercy on him) said: "If a time-bound supererogatory prayer is missed, it is recommended to make it up according to the more authoritative view (al-azhar), based on the hadith recorded in the two Ṣaḥīḥs: 'Whoever sleeps through a prayer or forgets it should pray it when he remembers it.' This is also supported by the fact that the Prophet (peace and blessings be upon him) made up the two rak'ahs of Fajr when he and his companions overslept in the valley and missed the dawn prayer until the sun had risen [narrated by Abū Dāwūd with an authentic chain]." And Allah, the Most High, knows best.
