Resolution No.(113): “The Suit Filed against the Muslim Journalist who has Republished Cartoons Mocking the Prophet (PBUH)“

Date: 23/7/1427 AH, corresponding to 17/8/2006 AD.

 

 

The Board received the following question:

What`s the ruling of Sharia on the suit filed against the journalist Jihaad Al-Momani at Amman Sharia Court/ Cases Court before the judge Salah Shewayaat for the purpose of proving the apostasy of that journalist on charges of republishing the mocking cartoons of the Prophet (PBUH) at Sheehan weekly newspaper, when he was its editor in chief. This is in addition to his writing an article included in the same issue of that newspaper, where he criticized the violent response of Muslims to those images. The article is entitled: “Muslims of the world be patient! “

Answer: All success is due to Allah

The Board believes that since the above case is at bar, it is difficult to give an opinion in this regard without considering the details necessary for delivering a Sharia ruling. On the other hand, the Board has no right to summon someone for a hearing, because no request was made for obtaining a Fatwa from the Fatwa Board to that end. Therefore, the Board is of the view that the Sharia Court has the right of guardianship in the above case and that its rulings are subject to the oversight of the Sharia Court of Appeal. And Allah Knows Best.

What is the difference between Tahajjud prayer and night prayer, and do they have a particular Witr prayer other than that of Isha (evening prayer)?

Tahajjud and Qiyam-Al-Lail (night prayer) are two words for the same meaning which is offering voluntary prayer at night after sunset, but before dawn break. However, Tahajjud is offered after waking up; whereas, Qiyam-Al-Lail is permissible before sleeping, or after it. Therefore, every Tahajjud is a Qiyam, but not every Qiyam is a Tahajjud. Moreover, there is no specified Witr for both of them, but Witr after Isha is by itself the Witr of Qiyam, and it is a Sunnah to postpone it until after Qiyam if the worshiper thought that he was most probably going to wake up in order to offer it, but if he wasn`t sure of waking up, then he is at liberty to offer it before going to bed as was reported in the Prophet`s Hadith.

In our region in southern Oman, specifically in the city of Taqah, there is a mosque that they say was built hundreds of years ago. This mosque is surrounded by graves, meaning it is in the middle and the graves are around it. People in our area differ, with some considering it permissible and others considering it forbidden to pray there. Moreover, my grandmother saw in a dream that she entered this mosque..."
 

Praying in this mosque is valid and and there is reprehensibility in its location so long as no grave exist within it. Besides, Sharia rulings aren't derived out of dreams. And Allah Knows Best. 

I suffer from absentmindedness and constant worries during prayer, what should I do?

You should take refuge in Allah from the whispers of the devil and life worries. You should also seek Allah`s help and offer a lot of Istigfar (seeking the forgiveness of Allah). And Allah Knows Best.

What should a woman who delayed making up for missed fast, due to menstruation, till the start of the next Ramadan?

Whosoever broke fasting in Ramadan, and was able to make up for it, but didn`t until the next Ramadan started, is obliged to make up for the missed days, and to pay the ransom as well. However, if he/she wasn`t able to before next Ramadhaan due to an excuse, then he/she should only make up for the missed days. And Allah Knows Best.
