Resolution No.(125)(1/2009): “Statement of the Iftaa` Board on Israel`s Flagrant Aggression Against Gaza”

Date: 8/1/1430, corresponding to 5/1/2009 AD.

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

The Board decided to issue the following statement regarding the events in Gaza:

Allah, The All-Mighty Says (What means): “To those against whom war is made, permission is given (to fight), because they are wronged;- and verily, God is most powerful for their aid.“ {Al-Hajj/39}. Allah, The Almighty, Is Testing His servants who believe in Him to show their true dependence on their Lord and their patience in facing their enemy. Allah The Most Exalted, Says (what means): “Thus (are ye commanded): but if it had been God’s Will, He could certainly have exacted retribution from them (Himself); but (He lets you fight) in order to test you, some with others.” {Muhammad/4}. Our Prophet (PBUH) was tried, so he persevered in patience, and faced his enemy, so he was granted victory.

 

Our enemy is attacking our brothers in Gaza; demolishing mosques, and killing both; women and children. Allah, The Almighty, Says (what means): “Nor will they cease fighting you until they turn you back from your faith if they can.” {Al-Baqarah/217}. 

The Messenger of Allah (PBUH) said: "A Muslim is a brother of another Muslim. So he should not oppress him nor should he hand him over to (his Satan or to his self which is inclined to evil). Whoever fulfills the needs of his brother, Allah will fulfill his needs; whoever removes the troubles of his brother, Allah will remove one of his troubles on the Day of Resurrection; and whoever covers up the fault of a Muslim, Allah will cover up his fault on the Day of Resurrection". {Agreed upon}. This Hadith indicates that a Muslim shouldn`t leave his Muslim brother fight the enemy alone. Our brothers at Gaza are heroes; we commend their steadfastness and pray that Allah helps them defeat the disbelievers. Allah Says (what means): “Men said to them: "A great army is gathering against you": And frightened them: But it (only) increased their Faith: They said: "For us God sufficeth, and He is The Best Disposer of Affairs." {Al-Imran/173}. However, we shouldn`t leave them fight that battle alone.

 

We stress that the Zionist`s aggression against our brothers in Gaza is an aggression against all Muslims because we are one nation, regardless of our different schools of thought. Every Muslim feels bitter for what`s befalling his brothers and regards it an aggression against himself. The Messenger of Allah (PBUH) said: "The believers in their mutual kindness, compassion and sympathy are just like one body. When one of the limbs suffers, the whole body responds to it with wakefulness and fever." {Agreed upon}.

Today, we are in dire need to join forces, stop blaming each other, and hold on to the testimony of faith:  “There is no God but Allah and Muhammad is His Messenger”. It is incumbent upon every Muslim to support his brothers in Gaza as much as he could, because it is our duty before Allah and we shall be called to account for it. The Messenger of Allah (PBUH) said: "He who equips a Ghazi (fighter) in the way of Allah is as if he has taken part in the fighting himself; and he who looks after the dependents of a Ghazi in his absence, is as if he has taken part in the fighting himself."

 

Our anger should be turned into an effective course of action; each according to his position and capacity. Allah, The Almighty, Says (what means): “On no soul doth God Place a burden greater than it can bear.” {Al-Baqarah/286}.

 

In Jordan, we: Al-Muhajireen Wal-Ansar (emigrants and supporters) have been united for over sixty years through standing by what`s right, helping al-Mujahidin (fighters in The Cause of Allah), and following the same faith (Islam), and this will continue, God`s willing, forever. This isn`t the first time in which the leadership, government and citizens of Jordan stand by the people of Gaza.

 

Aid convoys sent from Jordan to the people of Gaza are the vein, which supplies them with the basics of survival and steadfastness, and it should continue as such. Allah, The Almighty, Says (what means): “The Believers, men and women, are protectors one of another: they enjoin what is just, and forbid what is evil: they observe regular prayers, practise regular charity, and obey God and His Apostle.” {At-Tawbah/71}.

These are the very days in which a Muslim can express his sincere belief and pride in Islam as well as being a member of the nation of Prophet Mohammad (PBUH). It is an obligation that every one of us continues his support through every means possible: Jihad, wealth, encouragement, and sincere supplication to the Lord of The Worlds. Allah Says (what means): “O ye who believe! Persevere in patience and constancy; vie in such perseverance; strengthen each other; and fear God; that ye may prosper.” {Al-Imran/200}. And Allah The Almighty Knows Best.

I vowed to give a specific charity if a certain matter came to pass — what is the ruling on giving that charity before the matter is realised?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
Fulfilling a vow (nadhr) is obligatory, in accordance with the word of Allah the Almighty: "And let them fulfil their vows." [Al-Ḥajj/ 29] And the saying of our master the Messenger of Allah ﷺ: "Whoever vows to obey Allah, let him obey Him; and whoever vows to disobey Him, let him not disobey Him." (Reported by al-Bukhārī.)
The Shāfiʿī scholars distinguished between a financial vow (nadhr mālī) and a bodily vow (nadhr badanī). They permitted the fulfilment of a financial vow to be brought forward — before the stipulated condition is met — but did not permit the same for a bodily vow, which may only be fulfilled after the condition has actually been realised.
Shaykh al-Islām Imām Zakariyyā al-Anṣārī, may Allah have mercy upon him, states: "It is permissible to bring forward the fulfilment of a financial vow before the condition stipulated in it is met — such as saying: 'If I am healed, I vow to free a slave' or 'to give such-and-such in charity' — just as it is permissible to pay zakāh in advance. This is unlike a bodily vow, such as fasting." [Asnā al-Maṭālib, vol. 4/P.246]
Imām al-Bājūrī, may Allah have mercy upon him, states: "Like expiation other than fasting, a financial vow — such as saying: 'If Allah heals my sick one, I vow to free a slave for the sake of Allah,' or 'If Allah heals my sick one, I vow to free a slave on the Friday following the recovery' — it is permissible to bring it forward before the recovery in the first case, and before the Friday following the recovery in the second case." [Ḥāshiyat al-Bājūrī ʿalā Sharḥ Ibn Qāsim, Vol.2/P.596] And Allah the Almighty knows best.

What is the ruling on giving the expiation of an oath (Kaffarat al-Yamin) to a charity that feeds the poor?

 

 

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

It is allowed for a Muslim to appoint a proxy (agent) to distribute the expiation (Kaffarah) on their behalf. Our jurists have explicitly stated the permissibility of delegation (Tawkil) in the distribution of Zakat, Kaffarah, and vows (Nadr).

It is stated in Mughni al-Muhtaj (Vol.3/P.237): 'One has the right to pay the Zakat of their wealth personally... and they also have the right to delegate it.' And Allah the Exalted knows best.

When does the time for Udhiyah begin?

 
In the Name of Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
 
The permissible timeframe for Udhiyah (sacrificial offering) begins on the day of Eid al-Adha—the 10th of Dhul-Hijjah—once the sun has risen and a period of time sufficient to perform two brief prayer units (Rak'ahs) and two short sermons (Khutbahs) has passed. This window remains open until the sun sets on the final day of Tashreeq, which is the 13th of Dhul-Hijjah.
 
Our Master, the Messenger of Allah (peace and blessings be upon him), said: "Every valley of Mina is a place of sacrifice, and slaughtering may be done throughout all the days of Tashreeq." (Narrated by Al-Bayhaqi and Ibn Hibban)
 
The days of Tashreeq refer to the 11th, 12th, and 13th of Dhul-Hijjah.
 
The most virtuous time to perform the sacrifice is immediately after concluding the Eid prayer, based on the statement of the Prophet (peace and blessings be upon him): "The first thing we do on this day of ours is to pray, then we return and offer our sacrifice. Whoever does that has acted in accordance with our Sunnah (tradition), and whoever slaughters before that, it is merely meat he has provided for his family; it has nothing to do with the ritual sacrifice." (Reported by Al-Bukhari and Muslim)
 
What is meant here is an estimation of time rather than the actual performance of the prayer itself, as our Master, the Messenger of Allah (peace and blessings be upon him), used to offer the Eid al-Adha prayer immediately after sunrise.
 
The sacrifice is valid if performed at any time during these designated days, whether by day or by night, though slaughtering at night is considered disliked (Makruh). And Allah the Almighty Knows Best.

Is it obligatory to have an intention (niyyah) for every prayer?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
It is obligatory for the worshiper to have a specific intention (Niyyah) for every prayer, meaning they must consciously intend the act of worship they are performing. The intention is a pillar (Rukn) of the prayer, and the prayer is not valid without it. It is not a requirement to utter the intention verbally; rather, doing so is considered a recommended Sunnah. And Allah the Exalted knows best.
