Resolution No.(166): "Ruling of Sharia on Donating Part of the Liver"

Date Added : 05-10-2015

Resolution No.(166)(7/2011) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling of Sharia on Donating Part of the Liver"

Date: 26/8/1432 AH, corresponding to 28/7/2011 AD.

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

During its eleventh session held on the above given date, the Board reviewed the ruling on donating part of the liver and decided that it is permissible provided that the conditions of Sharia in this regard are met. Rather, the Board is of the view that whoever does this out of kindness towards a patient, who is really in need for it, will be rewarded by Allah. Allah, The Almighty, Says (what means): "and if any one saved a life, it would be as if he saved the life of the whole people." {Al-Mai`dah/32}.

The conditions of Sharia as far as this issue is concerned are as  follows:

1- The donor should be a responsible person.

2- Taking this part from the donor`s liver doesn`t inflict any harm on his life since the Sharia maxim in this regard reads: (Harm shouldn`t be eliminated  by inflicting reciprocal harm). Therefore, it is imperative to consult specialized expert doctors at each case.

3- It is donated out of charity, not in exchange for a material profit.

4- Transplanting this part of the liver is the only medical means to cure the patient.

5- The operation is most likely to be a success. And Allah Knows Best.

Summarized Fatawaa

What is the ruling on one who sees moisture on his clothes and doubts whether it is semen or pre-seminal fluid (madhy)?

Whoever finds moisture upon waking from sleep and doubts whether it is semen or madhy, and cannot distinguish between them, he may choose between them and act according to his choice. If he wishes, he can consider it semen and perform the ritual bath, or consider it madhy, perform ablution, and wash what it has soiled. This is because if he fulfills the requirement of one of them, he is definitively free from it, and the default is his innocence from the other. And Allah the Almighty knows best.

What are the signs of Laylat al-Qadr?

It is said that among its signs are:
● A sense of peace and tranquility during the night.
● The sun rises on the following morning white and without strong rays.
However, one should not be preoccupied with searching for its signs at the expense of worship. Allah has hidden its exact date so that we strive in worship throughout multiple nights, ensuring that we attain its great reward.

What is the ruling on forgetting an integral of the prayer?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

Whoever forgets an integral (Rukn) of the prayer and remembers it before reaching the equivalent point in the subsequent unit (Rak'ah), must return to it (i.e., perform it) and complete his prayer, then perform the prostration of forgetfulness (Sujud al-Sahw) at the end of his prayer. However, if he remembers it after reaching the equivalent point in the subsequent unit, the Rak'ah in which the integral was forgotten is invalidated, and the current unit takes its place; he then completes a full Rak'ah to compensate and performs the prostration of forgetfulness.

It is stated in Nihayat al-Muhtaj ila Sharh al-Minhaj (Vol.1/P.543): 'If he becomes certain at the end of his prayer, or after the Salam—provided the interval is not long according to custom and he has not stepped on an impurity—that he omitted a prostration from the final Rak'ah, he must perform it and repeat the Tashahhud, as his previous Tashahhud occurred before its proper place. If the omission was from a Rak'ah other than the final one, he must perform a full Rak'ah, because the deficient unit was completed by a prostration from the subsequent one, rendering the rest of that subsequent unit void.' And Allah the Exalted knows best.

Who is responsible for performing the aqiqah?

All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
The one upon whom the 'aqīqah is incumbent is whoever is obligated to financially maintain the newborn — whether the father, paternal grandfather, or mother. It is to be performed from their own wealth, not from the wealth of the newborn child.
As for one upon whom the financial maintenance of the newborn is not obligatory, they may not perform the 'aqīqah except with the permission of the one upon whom it is obligatory — namely, the father. And Allah Almighty knows best.
