"Ruling on Demonstrations"

Date: 5/4/1432 AH, corresponding to 10/3/2011.

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

During its fifth session held on the above given date, the Board stressed that it is incumbent upon every Muslim to adhere to the Law of Allah, invite others to fight corruption, resort to dialogue, and seek comprehensive reform as indicated in the following verse: " I only desire (your) betterment to the best of my power; and my success (in my task) can only come from God. In Him I trust, and unto Him I look." {Hud/88}. This is in addition to inviting people to the way of Allah with wisdom and beautiful preaching.

In response to a number of inquiries regarding the ruling of Sharia on demonstrations and sit-ins, taking into consideration their diversity,  multiple slogans, aims, banners and  repercussions, the Board has drawn up a set of governing rules that emanate from the objectives of Islamic Law (Sharia):

First: There is no other method of expressing one`s point of view, such as constructive dialogue and exchange of advice between influential members of society and decision makers.

Second: They don`t lead to blood-shed, killing , or harm.

Third: The damage resulting from them isn`t bigger than their expected benefit.

Fourth: They don`t involve or lead to acts that damage the interests of the country and its people.

Fifth: They shouldn`t involve any acts of transgression against public or private institutions.

Sixth: They aren`t exploited by foreign parties to work havoc upon society.

Seventh: They don`t lead to planting the seeds of trial amongst the members of the same society, undermine the country`s security, incite violence and sectarianism, or division.

Eighth: They don`t violate the provisions of Islamic Sharia, such as the unlawful mixing between the two sexes.

Ninth: They don`t lead to intimidating peaceful citizens by inflicting damage on their different properties, the spread of theft or violation of the sanctity of houses and families.

On its part, the Board recommends that scholars undertake their role through providing guidance and reform, and  giving precedence to the higher interests of our nation and country. We pray that Allah keeps this country safe and peaceful, spares it all sorts of trials, along with the rest of the Muslim countries. Indeed, He Is The Best to protect and The Best to help.

If a woman becomes pure from menstruation before the Fajr Adhan in Ramadan, is she required to fast?

If a woman becomes pure (from menstrual period) before the Fajr Adhan, she must fast, as the impediment preventing her from fasting has been removed. The Sharia maxim in this regard states: "When the impediment is removed, the obligation returns."
She should then make the intention to fast before Fajr and perform ghusl (ritual purification) for prayer, whether before or after Fajr.

What is the ruling on swearing an oath by the Prophet ﷺ, and does such an oath take effect according to Imām Aḥmad ibn Ḥanbal, requiring expiation upon its breach?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
Swearing an oath by a created being is disliked (makrūh) in our Shāfiʿī school. Shaykh al-Islām Imām al-Nawawī, may Allah have mercy upon him, states: "Swearing by a created being is disliked — such as swearing by the Prophet, the Kaʿbah, Jibrīl, the Companions, or the Prophet's family. Al-Shāfiʿī, may Allah have mercy upon him, said: 'I fear that swearing by other than Allah the Almighty may constitute an act of disobedience.' The scholars of the school explained this to mean: that is, something forbidden and sinful — indicating that he had some hesitation in the matter. Al-Imām stated: the established position of the school is that it is categorically not forbidden, but rather disliked. Furthermore, whoever swears by a created being, his oath does not take effect and no expiation (kaffārah) is required if he breaks it." [Rawḍat al-Ṭālibīn wa ʿUmdat al-Muftīn, Vol. 11/P.6]
According to the Ḥanbalī school, however, expiation becomes obligatory upon one who swears by our master the Prophet ﷺ and then breaks his oath. Imām al-Bahūtī al-Ḥanbalī, may Allah have mercy upon him, states: "No expiation is required for swearing by other than Allah the Almighty, even if the oath is broken — because expiation was made obligatory for swearing by Allah and His attributes, out of reverence for His names, and nothing else is equal to Him in this regard... except in the case of swearing by our Prophet Muḥammad ﷺ, for expiation becomes obligatory when one swears by him and then breaks the oath. This was explicitly stated in the narration of Abū Ṭālib, because he is one of the two conditions of the two testimonies of faith by which a disbeliever becomes a Muslim. Ibn ʿAqīl held the view that swearing by any of the other prophets, peace and blessings be upon them all, carries the same ruling." [Sharḥ Muntahā al-Irādāt, Vol. 3/P.441]. And Allah the Almighty knows best.

Can Zakah or Zakat al-Fitr be given to a poor brother?

Yes, it is allowed to give Zakah or Zakat al-Fitr to a poor brother, as he is considered among the eligible recipients.

What is the ruling on kidney dialysis while fasting in Ramadan?

Kidney dialysis breaks the fast because the dialysis fluid is nutritive, as confirmed by medical experts. Additionally, it involves the entry of substances into the body cavity (jauf).
A patient undergoing dialysis must make up for that day after Ramadan. If they are unable to do so, they must pay fidyah by feeding one needy person for each day they missed.
