Resolution No.(213)(3/215) by the Board of Iftaa`, Research and Islamic Studies:

“Ruling on Teaching Hajj Rituals through Shapes Simulating the Ka`bah and other Places“

Date:25/ Jumadah Al-Akhirah/1436 AH, corresponding to 15/4/2015 AD.

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

The Board reviewed in its fourth session held on the above date the following question:

We are a public service company, and we would like to establish an educational project that aims at teaching the pillars of Hajj to school students through simulating the Hajj rituals such as the Ka`bah, sai` between Safa and Marwa, Arafaat Moutain, Mina, and the Jamaraat, to whoever desires to learn how to perform this obligatory act of worship. What is the ruling of Islamic Sharia on that?

Knowledge is prescribed in Sharia; particularly, that which is useful in worldly life and saves from Hellfire in the Hereafter, and this applies to teaching the rituals of Hajj and Umrah. Allah Says {what means}: “O ye who believe! When ye are told to make room in the assemblies, (spread out and) make room: (ample) room will God provide for you. And when ye are told to rise up, rise up God will rise up, to (suitable) ranks (and degrees), those of you who believe and who have been granted (mystic) Knowledge. And God is well- acquainted with all ye do.” {Al-Mujadilah/11}. Also, Allah`s Apostle said regarding the virtue of being knowledgeable in the rules of Sharia: “If Allah wants to do a favor to somebody, He bestows on him, the gift of understanding the Quran and Sunna.” {Bukhari}.

Teaching Hajj rituals through creating shapes and images of holy sites that simulate those in real Hajj is permissible, rather, it is a good deed that helps people understand the correct way of performing Hajj and Umrah, for it was reported that Allah`s Apostle used to teach his companions through signs and demonstration. Abdullah Bin Masoud narrated: “The Prophet drew a square and then drew a line in the middle of it and let it extend outside the square and then drew several small lines attached to that central line, and said, "This is the human being, and this, (the square) in his lease of life, encircles him from all sides (or has encircled him), and this (line), which is outside (the square), is his hope, and these small lines are the calamities and troubles (which may befall him), and if one misses him, an-other will snap (i.e. overtake) him, and if the other misses him, a third will snap (i.e. overtake) him.” {Bukhari}.

However, it is imperative to warn visitors of these educational sites that the images and shapes simulating the Ka`bah, Safa and Marwa, Arafat, Mina, and the Jamaraat are mere educational representations, so it isn`t allowed to turn to them or glorify them, because this is restricted to the private nature of the sacred sites. It was stated in the book: “Facing the Ka`bah is intended for honoring it.” [Al-Moheet Al-Borhani vol.5/pp.396]

Moreover, it is worth stressing two points:

First: It is impermissible to belittle these images and shapes, or make them a subject of mockery.

Second: They  shouldn`t be a meticulous copy of the real sites in Hajj, rather, they should be of smaller size and hold signs that indicate their educational nature. On its part, the Board recommends that such project is supervised by the Ministry of Religious Endowments. And Allah Knows Best.

What is the ruling of Islamic Law regarding one who purchases a sacrificial animal (uḍḥiyah) and it then develops a defect before slaughter?

Praise be to Allah, and peace and blessings upon our master, the Messenger of Allah.
If a defect that invalidates the sacrifice (uḍḥiyah) arises after its purchase — for example, if one purchased a sound, defect-free animal, and it then developed a limp, blindness in one eye, or a similar defect before slaughter — it does not fulfill the requirement of a valid uḍḥiyah, according to the Shāfi'ī school.
It is stated in Asnā al-Maṭālib fī Sharḥ Rawḍ al-Ṭālib (Vol.1/P.535): "Even if the limp develops [in the animal] while the knife is upon it, it still does not fulfill the requirement, because it is lame at the moment of slaughter — this is analogous to a case where a sheep's leg breaks and one hastens to slaughter it [in that condition]."
The Ḥanbalī school, however, held that if the one offering the sacrifice purchased the animal while it was sound and defect-free, and a defect then befell it afterward, the sacrifice remains valid and there is no obligation to replace it.
It is stated in Masā'il al-Imām Aḥmad, one of the Ḥanbalī reference works (Vol.8/P.4021): "I said: If a person purchases the sacrificial animal while it is sound, and it is then afflicted with illness, blindness in one eye, or a broken limb [before slaughter]? He [Imam Aḥmad] said: It is said that it still fulfills the requirement. Isḥāq said likewise, because he purchased it while sound, and the defect befell it only afterward, so it remains sufficient on his behalf." [End of quote]
Accordingly, a sheep afflicted with a defect that invalidates the sacrifice does not fulfill the requirement of a valid uḍḥiyah — whether the defect arose after purchase or during the slaughter itself — according to the Shāfi'ī school. However, there is no objection to following the Ḥanbalī position on this matter [as a valid alternative]. And Allah, the Most High, knows best.

When does the time of Isha' prayer end?

What is the ruling of Islam on swearing by Allah without intending to take an actual oath?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
If someone swears by Allah without intending to take an actual oath, and without the firm resolve to bind themselves to it, then there is no sin or expiation (Kaffarah) required of them. Allah the Exalted says {what means}: 'God will not call you to account for thoughtlessness in your oaths, but for the intention in your hearts; and He is Oft-forgiving, Most Forbearing.' [Al-Baqarah/225]. However, a Muslim should avoid swearing oaths excessively so that their tongue does not become accustomed to it. Allah the Exalted says {what means}: 'And make not God’s (name) an excuse in your oaths against doing good, or acting rightly, or making peace between persons; for God is One Who heareth and knoweth all things.
' [Al-Baqarah/224]. And Allah the Exalted knows best."

What is the ruling on praying in congregation at the mosque?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
Congregational prayer (Salat al-Jama‘ah) is a communal obligation (Fard Kifayah) for resident men regarding the performance of the prescribed (obligatory) prayers. For men, praying in congregation at the mosque is better than praying elsewhere, such as at home. On the authority of Abdullah bin Umar, the Messenger of Allah ﷺ said: 'Prayer in congregation is twenty-seven degrees more excellent than the prayer of a person alone' (Reported by Bukhari & Muslim). Furthermore, on the authority of Abu Hurayrah, the Messenger of Allah ﷺ said: 'Shall I not tell you that by which Allah erases sins and raises ranks?' They said, 'Of course, O Messenger of Allah.' He said: 'Performing wudu thoroughly despite difficulties, taking many steps toward the mosques, and waiting for the next prayer after the prayer; that is your Ribat (steadfastness)' (Narrated by Muslim).
 
As for a woman, her praying in congregation at home is better for her than in the mosque, according to the saying of our Master the Prophet ﷺ: 'Do not prevent your women from attending the mosques, but their homes are better for them' (Narrated by Abu Dawood). Young boys should be encouraged to attend the mosques and congregational prayers so they may become accustomed to them. And Allah the Exalted knows best.
