Prohibiting the removal of the uteri of challenged girls

 Prohibiting the  removal of the uteri of challenged girls, and society`s responsibility towards them

 

Praise be to Allah, and peace and blessings be upon our master, Prophet  Muhammad and  upon  all his family and companions:

The Iftaa` Board, in its 11th session held on Thursday (7 /Rabia1st./ 1435AH) corresponding to  (9/1/2014AD), reviewed  the issue of Sharia ruling on removing  the uteri of mentally challenged girls  under the pretext that such procedure relieves them from health problems and maintains  their personal hygiene. Therefore, the Board has considered  the views of  specialized educators and physicians, and consequently realized the negative effects of such operations. After careful review  and deliberation, it decided the following:

It is only  permissible to remove an organ of Allah`s ,The Almighty`s, creation  in cases that are treated with such procedure. As regards mentally and physically challenged girls, the Board sees no excuse allowing such operations which involve interfering with Allah`s creation, surgical risks,  and negative effects which facilitate abuse and harm  to those girls.

It is incumbent upon the parents and guardians  to take care of their challenged daughters   and keep them out of harm’s way. Societies are also responsible for  protecting  them against all kinds of exploitation and enacting laws necessary to ensure that  end since it is their right to be taken care of, so that the sin of those in charge of them is not multiplied once these girls are being abused. This requires all members of society to exercise patience with such  group  of people and seek reward from Allah for facilitating their life for the Prophet(PBUH) said in this regard: “Everyone of you is a guardian, and responsible for what is in his custody..”{Al-Bukhari and Muslim}.And Allah knows best.

Summarized Fatawaa

We collect funds from mosques and other sources, saying: "For the poor, the needy, widows, orphans, and those who do not beg insistently." After paying the stipends of the families registered with the Zakat Committee, an amount exceeding 6,000 dinars remained. Is it permissible for me to save it for upcoming months when I may not be able to collect the stipends?

These funds are received by the committee as representatives of the zakat payers to deliver zakat to those entitled to it. It is well-known that delaying zakat while being able to pay it is not permissible. Imam Al-Nawawi (may Allah have mercy on him) said: "Zakat must be paid immediately if one is able to do so, by the presence of wealth and the eligible categories." [Al-Minhaj] Therefore, the committee must distribute the zakat to the eligible recipients without installment payments or using it to purchase material goods for them, as the committee does not have authority over the poor to allocate it in this way. And Allah Knows Best.

What is the stance of Ahlus-Sunnah wal-Jama'ah regarding the historical figure known as 'the Sufyani,' who some say will appear at the end of times? And what is the stance of Ahlus-Sunnah wal-Jama'ah regarding the group that killed Al-Husayn ibn Ali (may Allah be pleased with them), particularly those who directly committed the killing, severed his head, and killed members of his family?

Most of the narrations about the signs of the Hour concerning the Sufyani, who is said to appear before the Mahdi, indicate that he is the leader of the army that will invade the Kaaba, and Allah will cause the earth to swallow them. We disassociate ourselves before Allah from those who killed Al-Husayn Ibn Ali (may Allah be pleased with them), supported his killing, or encouraged it, whether openly or secretly. The inner matters are left to Allah alone. And Allah The Almighty Knows Best.
 
 
 
 
 

Is it enough to say Tasbeeh (Saying Subhaana Rabbiya Al-‘Atheem during Rukoo`, and saying Subhaana Rabbiya Al-A‘laa during Sujood ) once, or twice during Rukoo`(Bowing in prayer) and Sujood (Prostration)?

All perfect praise be to Allah, The Lord of The Worlds                                                                                                                                                                  Yes, saying Tasbeeh once during Rukoo` and Sujood is enough, provided that the worshiper`s attentiveness of the heart isn`t undermined during each. As regards the recompense, it depends on the number of Tasbeeh. And Allah Knows Best.

Should a minor fulfill his vow?

The vow of a minor is countless because he isn`t required to meet the Sharia rulings at such an age, and it is desirable for him to fulfill that vow once he reaches puberty.
