قرار رقم: (109) حكم الدخان وبيعه

بتاريخ: 3/ 5/ 1427هـ ، الموافق: 30/ 5/ 2006م

 

 ورد إلينا سؤال يقول فيه صاحبه:

ما مدى مشروعية بيع السجائر والأراجيل والتمباك بأنواعه، وتأجير المحلات التجارية لذلك؟

 الجواب وبالله التوفيق:

رأى المجلس أن التبغ (الدخان) والتمباك لم يكن معروفاً في عهد رسول الله صلى الله عليه وسلم، ولا في عهد صحابته ـ رضي الله عنهم ـ، ولا في عهد أئمة المذاهب المجتهدين، وإنما عرف التبغ في القرن الحادي عشر الهجري، ولعدم وجود نص شرعي بتحريمه، ولكونه لا يسكر، فقد اختلف العلماء في حكمه ما بين الإباحة والكراهة والتحريم، وذلك حسب نظرتهم إلى الضرر الذي يحدثه.

هذا وقد أثبتت الدراسات بأن التدخين أضراره كثيرة على الصحة والبيئة والمجتمع والاقتصاد، فهو يحتوي على مادة النيكوتين السامة، ونسبة المصابين بالأمراض وخاصة مرض السرطان بسبب التدخين عالية. ويتعدى ضرره إلى غير المدخنين المتواجدين في الأماكن التي يشرب فيها الدخان أو التمباك، حيث إنهم يستنشقون الدخان ويدخل إلى أجسامهم مع الهواء الذي يتنفسونه، ويتأذون من رائحته الكريهة، وضرره على الاقتصاد كبير لما فيه من الإسراف والتبذير، لقوله تعالى: (وَلَا تُسْرِفُوا إِنَّهُ لَا يُحِبُّ الْمُسْرِفِينَ)    [الأنعام/141] وقال أيضاً: (إِنَّ الْمُبَذِّرِينَ كَانُوا إِخْوَانَ الشَّيَاطِينِ)   [الإسراء/27] ففي الأردن وحده كما أفادت المصادر المعنية زادت الخسائر جراء التدخين عن مليار وخمسمائة مليون دينار سنوياً.

ونظراً لذلك فإن مجلس الإفتاء يرى أن التدخين مما عمت به البلوى. ويتأكد تحريمه على كل شخص ثبت بأن التدخين يؤدي إلى إلحاق ضرر كبير به، أو يؤخر في شفائه قال الله تعالى: (وَلَا تَقْتُلُوا أَنْفُسَكُمْ إِنَّ اللَّهَ كَانَ بِكُمْ رَحِيمًا) [النساء/29]. كما يتأكد التحريم في حق كل شخص ينفق ما لديه من مال على التدخين ويحرم نفسه ومن هو مكلف بإعالتهم مما هو ضروري لمعيشتهم كالطعام والشراب واللباس وأجرة السكن والدواء والتعليم لقوله صلى الله عليه وسلم: (كفى بالمرء إثماً أن يضيع من يعول)(1).

كما يتأكد تحريم الدخان في الأماكن العامة، كالمساجد والمستشفيات والحافلات والسيارات والمدارس والأماكن التي يتواجد فيها غير المدخنين، لأنه يحرم على المسلم أن يؤذي ويضر غيره قال عليه السلام: (لا ضرر ولا ضرار)(2) وقال ايضاً: (المسلم من سلم المسلمون من لسانه ويده) (3) ونظراً للأضرار الجسمية الآنفه الذكر التي تلحق بالصحة والبيئة والمجتمع والاقتصاد نتيجة التدخين: فإن مجلس الإفتاء يرى وجوب مكافحة التدخين بالوسائل المتاحة، وتحريم الترويج والإعلانات التشجيعية للتدخين.

 ولذلك كله فإن مجلس الإفتاء ينصح (4) بعدم بيع الدخان والتمباك والأرجيلة وتأجير المحلات التجارية، سواء لغايات البيع أو الاستخدام والشرب. والله تعالى أعلم.

What is the ruling on public street water if it gets on a person's clothes or body?

The default ruling is that public street water is pure (tahir). If one is certain of its impurity (najasa), then a small amount that gets on the lower part of a person's clothes or body is overlooked (excused). And Allah the Almighty knows best.

Is it permissible to pay the Zakah (obligatory charity) for settling the debt of a deceased relative?

It is impermissible to pay the Zakah for settling the debt of the deceased since Zakah is paid to eligible recipients who are alive. As for the debts of the deceased, they are to be settled from the estate before dividing it amongst the heirs, but if the deceased didn`t leave an estate, then it is desirable for his/her heirs to settle those debts if they can afford them. When does the time for Udhiyah begin?

 
In the Name of Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
 
The permissible timeframe for Udhiyah (sacrificial offering) begins on the day of Eid al-Adha—the 10th of Dhul-Hijjah—once the sun has risen and a period of time sufficient to perform two brief prayer units (Rak'ahs) and two short sermons (Khutbahs) has passed. This window remains open until the sun sets on the final day of Tashreeq, which is the 13th of Dhul-Hijjah.
 
Our Master, the Messenger of Allah (peace and blessings be upon him), said: "Every valley of Mina is a place of sacrifice, and slaughtering may be done throughout all the days of Tashreeq." (Narrated by Al-Bayhaqi and Ibn Hibban)
 
The days of Tashreeq refer to the 11th, 12th, and 13th of Dhul-Hijjah.
 
The most virtuous time to perform the sacrifice is immediately after concluding the Eid prayer, based on the statement of the Prophet (peace and blessings be upon him): "The first thing we do on this day of ours is to pray, then we return and offer our sacrifice. Whoever does that has acted in accordance with our Sunnah (tradition), and whoever slaughters before that, it is merely meat he has provided for his family; it has nothing to do with the ritual sacrifice." What is meant here is an estimation of time rather than the actual performance of the prayer itself, as our Master, the Messenger of Allah (peace and blessings be upon him), used to offer the Eid al-Adha prayer immediately after sunrise.
 
The sacrifice is valid if performed at any time during these designated days, whether by day or by night, though slaughtering at night is considered disliked (Makruh). And Allah the Almighty Knows Best.
