The Iftaa` Department Refrains from Interfering in the Judiciary

 

 

Some media reported that the General Iftaa` Department refrained from issuing a Fatwa on the inadmissibility of the testimony of the woman who doesn`t wear Hijab.

 

In response to this claim, the Department wishes to make clear that the requested Fatwa is related to a case pending before the court. Therefore, it refrained from issuing that Fatwa to ensure the impartiality and independence of the judiciary system, the integrity of its provisions and non-interference in its affairs, as provided for in the legislations in force. This is to achieve justice and preserve the rights of the litigants.

 

The Department asserts that non-interference in cases pending before the court is its adopted approach since its establishment to safeguard the integrity of litigation from any external influences.

This is permissible because Allah The Almighty Says (What means): "They ask thee what is lawful to them (as food). Say: lawful unto you are (all) things good and pure: and what ye have taught your trained hunting animals (to catch) in the manner directed to you by Allah. eat what they catch for you, but pronounce the name of Allah over it: and fear Allah. for Allah is swift in taking account." [Al-Ma`idah/4]. However, it is prohibited to keep dogs for no benefit because Salim reported on the authority of his father that Allah's Apostle (PBUH) said: "He who kept a dog other than one meant for hunting or for watching the herd, lost two qirat of his reward every day." In addition, any Masjid that doesn’t have a Mua'than (The person who calls for prayers) and doesn`t raise the Adhan misses the reward of this great act. This is because Adhan should be raised for every group of people. However, the unified Adhan should be called in one Masjid and heard through all other Masjids. And Allah Knows Best.

What is the ruling when the duration of the monthly period varies, and sporadically increases?

If the period didn`t exceed (15) days from the first seeing of blood discharges until its end including the times of temporary cessation, then it is menses. But, if the period exceeded (15) days, then the woman experiencing this is Mostahadah (bleeding outside the time of monthly period), and should abide by her regular period, and consult one of the scholars.
