Resolution No.(157)(23/2010) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Supervising the Construction of Dwellings Funded by Non-Islamic Banks"

Date: 17/1/1432 AH, corresponding to 23/12/2010 AD.

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

During its twelfth session held on the above date, the Board reviewed the following question: 

I have an engineering office where I receive people who wish to construct buildings. They fall into two categories:

First: Those who have obtained usurious loans to construct a building and seek my supervisory services.

Two: Those who ask me to provide them with a construction plan and a cost the intended buildings to submit them to one of the non-Islamic banks to receive a usurious loan.

After prolonged deliberations, the Board decided what follows:

It is permissible for you to supervise the dwellings of the first category since it doesn`t involve any kind of usury as you charge a wage in return for your work.

As regards the second category, it is impermissible for you to supervise their buildings because doing so helps in committing usury. Allah Said in this regard (what means): "Help ye one another in righteousness and piety, but help ye not one another in sin and rancour: fear Allah. for Allah is strict in punishment." {Al-Ma`idah/2}. And Allah Knows Best.

Summarized Fatawaa

 I am an employee at Social Security, and I have heard that working with them is forbidden (haram) because they impose an interest rate of 2% on companies and individuals who are late in making payments. Is my job with them haram or questionable?

Please clarify the type of work. If it does not involve the usury (Riba) mentioned, we hope that there is no issue with it, as most of their funds are acquired in a lawful (Complies with the teachings of Sharia) manner. And Allah, The Almighty, Knows Best.

Is it permissible for a person to sever ties with his sister because her husband had quit prayer and done him harm?

A sister is a blood-relative and maintaining blood-relations is obligatory in Islam. As regards her husband, he should be invited to the way of Allah with wisdom and beautiful preaching.

What is the ruling on making up for missed fasting after the second half of Sha`ban (the month before Ramadhaan)?

One is obliged to make up for missed fasting before the start of next Ramadhaan, and regardless of offering it during the first, or the second half of Shab`an. This is because the prohibition mentioned in the Hadith is for offering absolute voluntary fasting in the second half of Sha`ban. And Allah Knows Best.

Is it permissible to make up missed prayers at the times in which praying is disliked?

All perfect praise be to Allah,The Lord of The Worlds                                                                                                                                                                        It is permissible to make up missed prayers at any time even that in which praying is disliked. Absolute supererogatory prayer is forbidden to be performed at the times in which praying is disliked, and this also applies to Ihram and Istikhara prayers. However, there is no harm in offering prayers in Mekah during those times. And Allah Knows Best.
