Resolution No.(290): "Jordan`s Position Paper on Abortion"

Resolution No. (290) (10 /2020) by the Board of Iftaa`, Research and Islamic Studies:

"Jordan`s Position Paper on Abortion"

Date: (29th of Shawwal, 1441 AH), corresponding to (21/6/2020).

All perfect praise be to Allah, the Lord of the Worlds, may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

In its 9nth meeting held on the above date, the Board of Iftaa`, Research and Islamic Studies reviewed the letter of the Prime Minister Dr. Omar Razzaz in which he requested studying the attached documents about "Jordan`s Position Paper on Abortion"  and delivering the ruling of Sharia on that.

After thorough consideration, the Iftaa` Board decided the following:

The content of the paragraphs attached under the heading "Jordan`s Position Paper on Abortion" complies with the Ijtihad related to the ruling of Sharia on abortion and in which the objectives of Sharia were taken into consideration.

We (Iftaa` Board) recommend making some changes that are deemed essential for the completion of the Sharia opinion in the above paper. They are as follows:

First: "Raising awareness of the unlawful and the unsafe sexual relations within all groups of society, (P.6)." We recommend changing "Raising awareness" into "Warning against" while changing "Unlawful" and "Unsafe, wherever they occur, into "Relationships outside of valid marriage."

Second: About the heading "Including Sexual Education, (P.5)" We recommend adding "In a manner consistent with our social values and the principles of Islamic Law."

Third: We recommend adding the General Iftaa` Department to the implementers in the paragraphs entitled "Including Sexual Education" and "Raising religious awareness."

Fourth: "Opening reproductive health clinics for the young, male and female, (P.5)." We recommend linking this with "In a manner consistent with our social values and the principles of Islamic Law."

Fifth: We also recommend linking the same phrase with "By nomination from the competent authorities," in margin No.(12), the system of forming an ethics board. And Allah The Almighty Knows Best.

What is the ruling on forgetting an integral of the prayer?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
Whoever forgets an integral (Rukn) of the prayer and remembers it before reaching the equivalent point in the subsequent unit (Rak'ah), must return to it (i.e., perform it) and complete his prayer, then perform the prostration of forgetfulness (Sujud al-Sahw) at the end of his prayer. However, if he remembers it after reaching the equivalent point in the subsequent unit, the Rak'ah in which the integral was forgotten is invalidated, and the current unit takes its place; he then completes a full Rak'ah to compensate and performs the prostration of forgetfulness.
 
It is stated in Nihayat al-Muhtaj ila Sharh al-Minhaj (Vol.1/P.543): 'If he becomes certain at the end of his prayer, or after the Salam—provided the interval is not long according to custom and he has not stepped on an impurity—that he omitted a prostration from the final Rak'ah, he must perform it and repeat the Tashahhud, as his previous Tashahhud occurred before its proper place. If the omission was from a Rak'ah other than the final one, he must perform a full Rak'ah, because the deficient unit was completed by a prostration from the subsequent one, rendering the rest of that subsequent unit void.' And Allah the Exalted knows best.

Does using a respiratory device (oxygen) affect the validity of fasting?

Using an oxygen device does not affect the validity of fasting because oxygen is a gas with no physical substance.
However, if medicinal substances with physical particles are added to the oxygen, its use would break the fast, as it enters the body cavity through a natural passage.

What is the ruling on someone who insults or deceives others while fasting?

Insulting or deceiving others is forbidden (haram) and diminishes the reward of fasting.
The Prophet ﷺ warned against deception, saying: "Whoever deceives is not one of us." [Narrated by Al-Tirmidhi]
However, their fast remains valid despite the sin.

Is it permissible for women to attend Tarawih prayer in the mosque?

Yes, it is permissible for women to attend Tarawih prayer in the mosque, provided they observe modesty, proper covering, and avoid mixing with men.
The Prophet ﷺ said: "Do not prevent the female servants of Allah from the mosques of Allah." [Bukhari and Muslim]
