Resolution No.(279)(13/2019), By The Board of Iftaa', Researches and Islamic Studies:

"Ruling on Using a Mosque`s Hall on Religious and Social Occasions"

Date: (11/ Ramadan/1440 AH), corresponding to (16/5/2019 AD).

 

All perfect praise be to Allah the Lord of the Worlds.

During its sixth session held on the above date, the Board reviewed the letter No.(4/2/3/2484) sent from His excellency Minister of Awqaf and Islamic Affairs Dr. Abdulnaser Abu Al-Basal, and reads as follows: I have enclosed a copy of the Awqaf Council`s resolution No.(3/16/2018), (31/12/2018) which asks for clarifying the ruling of Sharia on using the hall of late Ali Wadi`s mosque`s in Salhoob town, by the mosque`s committee, for paying condolences upon someone`s death, delivering religious lessons and lectures.

After deliberating, the Board arrived at the following decision:

Empty extra halls of a mosque are of two types:

First: If the creator of the endowment (Donor) stipulated using the hall annexed to the mosque for paying condolences, in case of someone`s death, and in accordance with teachings of Sharia, then that is permissible, because the stipulation of the donor has the same binding force as the text of Sharia. In other words, he has endowed this hall for social solidarity during hard times.

Second: If the creator of the Waqf didn`t make any stipulation regarding this hall, attention should be given to the following:

If the land was endowed by a public or a private party and the donor is alive, then there is no harm in using the hall for paying condolences. This of course after obtaining the permission of the donor and the Ministry of Awqaf in its capacity as administrator of the Waqf (Endowment), and to the extent which achieves benefit and facilitates for the people.

However, if the donor was dead, then the decision is up to the Waqf administrator, the Ministry of Awqaf, and to the extent that achieves benefit and facilitates for the people. And Allah the Almighty Knows Best.

What is the ruling on performing istinja' after passing wind from the anus?

Ablution is invalidated by passing wind from the anus, even without a smell. Only ablution becomes obligatory from it. Istinja' is not obligatory nor recommended. And Allah the Almighty knows best.

What is the ruling on a woman using contraception without her husband's knowledge if he is mistreating her?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
It is not permissible for a woman to use any means of delaying pregnancy without her husband's knowledge, consent, and mutual agreement. This is because having children is a sharʿī right belonging to both spouses equally in Islamic law. Imām al-Māwardī, may Allah have mercy upon him, stated: "The right to a child from a free woman is shared between them both" — meaning between the two spouses. [al-Ḥāwī al-Kabīr, 9/320]
It is therefore not permissible for either spouse to make a unilateral decision regarding the prevention of pregnancy without the consent of the other. We advise both spouses to discuss the matter with wisdom and mutual respect, so as to resolve any disagreement and arrive at a suitable solution that serves the interests of them both. And Allah the Almighty knows best.

What is the ruling on eating or drinking during the first Adhan?

It is permissible to eat and drink during the first Adhan because it takes place before the break of dawn. The purpose of this Adhan is to notify Muslims of the approaching dawn so they can prepare to stop eating when they hear the second Adhan.

What is the ruling on performing the Istikhara prayer after the Witr paryer?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
The Istikhara prayer (Prayer for seeking guidance) is a Sunnah. It consists of two units (rak’ahs) performed outside of the obligatory prayers, after which the person supplicates with the traditionally narrated du’a. It is permissible to perform it before or after the Witr prayer, as the Istikhara prayer is recommended at all times except during the disliked times—the periods in which prayer is prohibited. This is because its specific reason (the Istikhara and supplication) occurs after the prayer itself, and any prayer with a subsequent reason is not permitted during the prohibited times. It should be noted that the two rak’ahs of Istikhara are not fulfilled by performing only one rak’ah, nor by a prostration of recitation (Sajdat al-Tilawah), nor by a funeral prayer (Janazah).
