Resolution No.(9): “Ruling on the Amendments over the Moqarada Bonds Act“

Resolution No.(9) by the Board of Iftaa`, Research and Islamic Studies:  

“Ruling on the Amendments over the Moqarada Bonds Act“

Date: 29/5/1407 AH, 29/1/1987 AD.

 

Question: What is the ruling on the amendments over the Moqarada (A borrowing tool in favor of a company bonds act?
Answer: All perfect praise is due to Allah, The Lord of the Worlds.
After reviewing the articles of the interim, act no. (10), 1981, the proposed amendments and deliberating over them, the Board has decided the following:
A- Confirming the resolution of the Iftaa` Committee issued on the 8th of Feb. 1398 AH, 17/1/1978 on Moqarada draft-act and that its texts and sections comply with the rulings of Islamic Sharia.
B- Confirming the resolution of the Iftaa` Committee issued on the 8th of Feb. 1398 AH, 17/1/1978 on the permissibility of the government`s guarantee over settling the par value of Moqarada bonds within the specified dates since the government is considered a Third Party, and enjoys the general authorities in doing what is in the best interest of its citizens.
C- The Board noticed that the 12th article of the interim act No.(10),1981  has added-after stating that the government guarantees settling the whole due par value of the Moqarada bonds within the specified dates-that the amounts paid by the government  in this case are considered a zero-interest loan to the project, and becomes due once the bonds are totally settled. In other words, the government isn`t a Third Party anymore because the project itself has settled all the payments. In fact, the project borrowed from the government because it didn`t have the amount needed for settling the par value of the bonds. This is a kind of guarantee against loss given by the owner of the money from the Mudarib (co-partner) in a Mudaraba (co-partnership) contract, and this contradicts the rulings of a Mudaraba contract stipulated in Islamic Jurisprudence.
Therefore, the board believes that it is essential for the government to continue its guarantee role as a Third Party. This in order to avoid stipulating that subscribers shall endure any loss-as stated by the Iftaa` Committee in the aforementioned resolution-and consequently this transaction becomes acceptable in Sharia.
Therefore, the Board views that it is essential that article (12) ends with the words: “specified dates”, and that what comes after them is omitted. Actually, Waqf(religious endowment) projects, projects undertaken by municipalities and  financially as well as managerially independent organizations  from which this guarantee  shall benefit are amongst the vital projects that target the best interest of the citizens. The government is keen on holding such projects and promoting them in order to achieve eco-social development so long as there are sufficient guarantees, which secure their proper progress and supervision.
The government`s guarantee over settling these bonds within the specified dates entails no harm, or squander of public funds, rather, it is using them positively in rare cases and exceptional situations.
D- The Board has reviewed the proposed amendments included in the note attached with the official letter of the Minister in question and believes that they don`t contradict the rulings of Sharia in this regard and that it (Board) doesn`t object including them in the interim act. What is the ruling on the intention of fasting, where is its place, and when is its time?

The intention is a pillar of acts of worship; it is essential, and worship is not valid without it.
Its place is in the heart, and verbalizing it is recommended so that the tongue reminds the heart. Its meaning is to be determined to abstain from nullifiers of fasting during the upcoming day with the intention of worship and obedience to Allah Almighty. This meaning is naturally present in every Muslim on every night of Ramadan, so there is no need for obsessive doubts. If one says, "I intend to fast tomorrow for the sake of Allah," it removes any doubts.
Its time is from after sunset until before the true dawn.

What is the wisdom behind legislating the Udhiyah?

The Muslim must know that through the Uḍḥiyah, he complies with the command of Allah, the Exalted, and performs a worship that brings him closer to Allah and distances him from the Fire.
 
The Uḍḥiyah holds profound wisdoms and noble meanings, including:
 
1-Reviving the Sunnah of Abraham, peace be upon him: He complied with Allah's command when He ordered him to slaughter his son Ishmael. Abraham, peace be upon him, succeeded in the test, and when he was about to slaughter his son, Allah sent down a ram to ransom Ishmael and commanded him to slaughter it instead. Allah, the Exalted, says {what means]: "And when he reached with him [the age of] exertion, he said, 'O my son, indeed I have seen in a dream that I [must] sacrifice you, so see what you think.' He said, 'O my father, do as you are commanded. You will find me, if Allah wills, of the steadfast.' And when they had both submitted and he put him down upon his forehead, We called to him, 'O Abraham, You have fulfilled the vision.' Indeed, We thus reward the doers of good. Indeed, this was the clear trial. And We ransomed him with a great sacrifice." [Al-Ṣāffāt/102-107]. Thus, the sacrificial offering became an enduring Sunnah until the Day of Judgment, and Muslims offer their wealth as sacrifices, drawing closer to Allah, the Exalted, reviving this great Sunnah.
 
2-Providing abundance for people on Eid day and the Days of Tashrīq: Among the wisdoms of the Uḍḥiyah is that the Muslim provides generously for his family, neighbors, relatives, and the poor during these days. The Muslim is encouraged to eat from his sacrifice, give charity from it to the poor, and gift from it to his wealthy neighbors. Thus, goodness spreads throughout the entire community. The Prophet, peace and blessings be upon him, said: "The Days of Tashrīq are days of eating and drinking." (Narrated by Muslim). Allah, the Exalted, says {what means}: "And the camels and cattle We have appointed for you as among the symbols of Allah; for you therein is good." [Al-Ḥajj/36]. This good includes the good of both this world and the Hereafter.

Is it a condition for the mosque where I‘tikaf is performed to hold Jumu‘ah prayers?

No, it is not a condition for the mosque where I‘tikaf is performed to have Jumu‘ah prayers. However, if a person vows to perform continuous I‘tikaf, and Jumu‘ah occurs within that period, then they must observe I‘tikaf in a mosque where Jumu‘ah is held so that they do not break their continuity by leaving for Friday prayer.

Is it permissible for a woman who has become pure before the end of forty days of confinement to perform different acts of worship? and is it lawful for her husband to have sex with her?

Once postpartum bleeding ceases and she is certain that it won`t happen again, she becomes pure, and so she should perform Ghusl (ritual bath), pray, and fast. She can also have sex with her husband even before the end of (40) days because the minimum of postpartum bleeding is a moment, and the maximum is (60) days. However, the postpartum bleeding for the majority of women is (40) days, but this does not apply to rest of them.
