Resolution No.(233): "Ruling on Producing Non-Alcoholic Drinks Using the Same Line that Produces Alcoholic Drinks"

Resolution No.(233)(1/2017) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Producing Non-Alcoholic Drinks Using the Same Line that Produces Alcoholic Drinks"

Date: (7/Jumada Al-Akhirah/1438 AH), corresponding to (6/3/2017).

 

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

 

During the second session held on the above date, the Board reviewed the question sent from the Director-General of Food and Drug Administration, His Excellency Dr. Obeidat, and it reads as follows:

Could your Grace clarify the ruling of Sharia on the letter of the Jordan Company for Investments in which they demand canning non-alcoholic drinks using the exact line that produces alcoholic drinks after having that line cleaned thoroughly with water, steam and different sterilizers, and after every produced quantity. It is worth noting that the preparation process of both types of drinks is completely separated. Moreover, the Company is willing to test different samples from the non-alcoholic drinks to make sure that they are alcohol-free, and that the product itself matches the technical specifications set for it?

Answer: After deliberations, the Board decided the following:

Prudence in matters related to drinks is among the essentials of Ijtihad (Independent reasoning), and it relies on many an evidence from Sharia. One of these is that the Prophet (PBUH) prohibited his companions from storing non-alcoholic drinks in certain utensils, namely Al-Hantam (pitcher smeared with pitch) and the Gourd because they could cause the liquid to be become intoxicating. Therefore, this prohibition aims to prevent harm.

Accordingly, the Iftaa` Board is of the view that it isn`t permissible for any factory to produce lawful drinks using the exact production line of unlawful drinks. This is in order to leave no room for error during the production process and to prohibit what may lead to committing sins. And Allah Knows Best.

An Arab young man had an illegitimate sexual relationship with a Christian American while she was staying in one of the Arab countries. After she returned to America, she told him that she had doubts that she was impregnated by him. It is worth pointing that it is hard for him to get a visa to the USA. What is the ruling of Sharia on this?

Zina (Adultery and extramarital relations) is one of the grave sins that incur the wrath of Allah if the adulterer didn`t make immediate repentance. However, the child isn`t attributed to the adulterer. Rather, he/she is attributed to the woman who got pregnant by him and, according to Sharia, it isn`t considered a legitimate child of the adulterer. And Allah The Almighty Knows Best.

I`m a married young man. I fell in love with a widow and proposed to her but her family refused because they feared that this would have an adverse impact on the future of her children. However, we entered into unregistered marriage and told my family and even my wife about it. I`m a person who fears Allah, The Almighty and want to clear myself from any liability before Him, The Exalted. What should I do?

It is imperative that you proclaim this marriage to preserve rights. Therefore, you must register it in an Islamic court. A second marriage isn`t forbidden, however, if the unregistered marriage had taken place without the consent of the woman`s guardian nor the presence of two honorable witnesses, then it is considered void and your relationship with this woman is forbidden. Therefore, you must conclude a new marriage contract with the approval of her guardian and the presence of two honorable witnesses. We advise you to fear Allah and adhere to the teachings of Sharia in this regard since sinful conduct is that which turns in your heart (making you feel uncomfortable) and you dislike that it would be disclosed to other people. And Allah The Almighy Knows Best.

Who is obligated to fast?

The one obligated to fast is the Muslim who is of sound mind, mature, capable of fasting, and free from obstacles such as menstruation or postpartum bleeding. And Allah Knows Best.

Is it permissible for a person who had vowed to give a certain amount of money to another, but didn`t find the latter to donate that money to the mosque?

In principle, the vowing person should abide by his vow as much as possible. Therefore, if he couldn`t find the person that he had made the vow for, then the vow itself is countless and nothing is due on its maker. However, if the latter happens to find the former later on then, he has to give him that money.
