Resolution No.(235)(3/2017) by the Board of Iftaa, Research and Islamic Studies:

"Getting Rid of Ill-Gotten Money"

Date: (7/Jumada Al-Akhira/1438), corresponding to (6/3/2017)

 

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

During the second session held on the above date, the Board reviewed the following question: 

I have worked for a usurious bank, but I`m now retired. Out of my salaries, I managed to construct a building of my own, and leased it against (1200 Dinars) per month. Is this income lawful? are my children allowed to benefit from it?, and how can I purify that money?

After deliberations, the Board decided the following:

There is no harm that you and your children benefit from the revenue of that building regardless of its source because the sin of usury or helping others to commit that sin falls on the person himself, has nothing to do with the money, and that person can free himself from the liability by sincere repentance, seeking Allah`s forgiveness, and never committing that sin again. It is hoped that this in addition to giving charity will avail in purifying that money, with Allah`s mercy and forgiveness. And Allah Knows Best.

Is it permissible to move a grave from its current location to another place, for example, from a garden in a home to a cemetery, knowing that the grave has been there for a long time, about fifty years?

It is not permissible to move the deceased from his grave, as this may result in breaking his bones and violating his sanctity. Such actions are not allowed. And Allah Knows Best.

What is the ruling of Sharia on looking at one`s Mahram women?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.
A Mahram man (man impermissible for a woman to marry) is permitted to look at what usually appears from his Mahram women (women impermissible for a man to marry) while doing their daily housework, with the exception of their private parts. And Allah The Almighty Knows Best.

Is it permissible for a husband to stop his wife from visiting her family?

A husband shouldn`t stop his wife from visiting her family, and it is disliked for him to do so because such an act makes them harbor feelings of hatred against him.

My husband wanted to sell a piece of land that was his own, but his father insisted that he transfer the land in his (the father’s) name so that he could sell it at a higher price. Then, my husband and his father would split the price. After my father-in-law sold the land, he denied everything and refused to acknowledge my husband’s right. My father-in-law passed away a year ago, and my husband’s brothers divided the inheritance, refusing to acknowledge that this land was a trust held by their father for my husband until it was sold. Are they sinful for knowingly denying that the land belongs to my husband, and what is the ruling on praying against them?

Among the rights of the deceased upon their heirs are: preparing them for burial at death, settling their debts, returning people’s rights to them, executing their will, and then dividing their estate. What was mentioned in the question falls under the rights of others, even if they are among the heirs, and the deceased is not absolved of it unless it is returned to its rightful owners. This is because Allah, Almighty, forbids consuming others' wealth/properties unjustly. However, do not give up on seeking a solution by involving righteous and well - respected individuals who may have influence over them, in the hope that Allah guides them to goodness and correctness. As for supplicating against them, the prayer of the oppressed is not rejected, even if the oppressed person is not a Muslim. And Allah knows best.
