Resolution No.(217): "Ruling on Irrigating with Treated Waste Water"

Resolution No.(217)(7/2015) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Irrigating with Treated Waste Water"

Date: 24/ Zolhijjah/1436 AH, corresponding to 8/10/2015 AD.

All perfect praise be to Allah, The Lord of The Worlds, and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

On the above given date, the Board reviewed the question sent by his Excellency, the Secretary-General of the Water Authority, Mr. Habashneh, and it reads as follows:

I would like to attract your attention to the fact that waste water treatment plants produce water in accordance with the latest international techniques that meet international and local standards.

It is important to use this water in line with the Jordanian waste water treatment quality standards, and for different uses; especially, the restricted irrigation, through securing large quantities of clean irrigation water. Would you clarify the opinion of Islamic Sharia on using treated waste water for irrigation?

After researching and deliberating, the Board arrived at the following view:

It is permissible to irrigate with treated waste water and to eat from the fruit of such plantation because the ruling pertaining to the fruit isn`t affected by whether the water is pure or impure. This is indicated by the question directed to Al-Imam An-Nawawi: "If the plantation and the fruit were irrigated with filthy water, or their soil was fertilized with it, is it lawful to eat their product? He replied: yes, it is." {Fatwas of An-Nawawi}.

However, it is imperative to abide by the sanitary regulations stipulated in this regard in order not to pollute the environment, ruin the plantation and the fruits, or cause harm to human beings. Moreover, scientific and medical standards should be observed as well. And Allah Knows Best.

What is the ruling on a person in a state of major impurity (junub) or a menstruating woman (ha'id) reciting the Quran from memory?

It is not permissible for a menstruating woman, a postpartum woman, or a person in a state of major impurity to recite anything from the Quran, whether from memory, from the Quran, from a phone, or a computer. It is also not permissible for them to touch the Quran, based on what was reported from Ali bin Abi Talib that the Prophet (peace be upon him) was not prevented from anything regarding the Quran except major impurity (janabah). (Reported by al-Tirmidhi who said it is a hasan sahih hadith). Menstruation and postpartum bleeding are analogous to major impurity (janabah) as they are all major impurities (hadath akbar).
For those mentioned, it is permissible to mention Allah and supplicate even with verses from the Quran, provided they do not intend them as recitation of the Quran, but intend them as remembrance (dhikr) or supplication (du'a). And Allah the Almighty knows best.

 
Are the mother's maternal and paternal uncles, and the father's maternal and paternal uncles, considered among the unmarriageable kin (Maharim)?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
A mother’s maternal uncle and her paternal uncle, as well as a father’s maternal uncle and his paternal uncle, are all considered among the unmarriageable kin (Maharim). And Allah the Exalted knows best.

Why was the exact date of Laylat al-Qadr concealed?

The wisdom behind this is to encourage Muslims to strive in worship throughout all the nights of Ramadan, or at least in the last ten nights. By doing so, they will earn the reward of observing Laylat al-Qadr as well as the reward of worshiping on other blessed nights.

Is it permissible for one to shake hands with his uncle`s daughter?

No, it isn`t because he is a non-Mahram (Marriageable) to her.
