Resolution No.(141),(6/2010): "Ruling on Investment at the Dead Sea Area"

Date: 7/5/1430AH, corresponding to 24/4/2010AD

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

During its fourth session held on the above date, the Board reviewed the questions sent by Jordan Heritage Revival Company regarding the ruling of Sharia on swimming and picknicking at the Dead Sea area as well as investing that area in building hotels that neither serve alcoholic drinks, nor contain any forbidden matters.

After thorough studying and deliberating, the Board decided what follows:

The Board is of the view that it is permissible to invest the Dead Sea area in building hotels so long as these don`t sell any forbidden items such as alcoholic drinks, or pork, and don`t have mixed swimming pools. As regards swimming and pickncking in that area, there is no Sharia approved evidence that forbids doing that, because in principle things are permissible unless forbidden by an established evidence from Sharia: the Noble Quran and the Prophetic Sunnah. And Allah Knows Best.

Should a woman who broke her fast because of delivery make up for missed fasting days before the next Ramadhaan, and what is the expiation due on her in case she delayed making up for them ?

She should make up for missed fasting days before the start of next Ramadhaan if possible, but if she didn`t while being able to, then she is obliged to make up for them along with feeding a needy person for each delayed day of the missed fasting days. However, if she wasn`t able to make up for the missed fasting days before the start of next Ramadhaan, she has to fast a day for every day that she missed, and no ransom is due on her.

Is it allowed for me to donate a flat to each of my children except one considering that the tuition fees I paid for the latter`s university study are equal to the price of the flat? In other words, he has received his share and this is why I`m donating a flat to my other children?

Yes, it is permissible because you want to treat them justly. And Allah The Almighty Knows Best.

Is it permissible to pay the expiation of an oath to a charitable party as it feeds the poor and needy such as Tkiyet Um Ali?

All perfect praise be to Allah, The Lord of The Worlds, and May His Peace and Blessings be upon our Prophet Muhammad and upon all of his family and companions.

There is no harm on authorizing someone to handle the expiation of another to the poor and needy, since Shafiee's jurists stated that authorizing someone for the purpose of distributing Zakah, expiation and vow is permissible as stated in [Mughni Al-Muhtajj, vol.3 pp.237]. At last, the intention of the person who intends to authorize someone else suffices in this regard. And Allah Knows Best.

Is love allowed or forbidden in Islam?

If love refers to the involuntary inclination of the heart, a person isn`t held accountable for it; however, whatever follows this in terms of gazing, meeting, and the like is forbidden. And Allah The Almighty Knows Best.
