The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. What is the Islamic ruling regarding a person finding buried treasure, whether gold or artifacts, and what is their share of it?

If the buried treasure is Islamic, it is considered Luqta (lost property), and the finder must announce it to locate its owner. If all efforts to find the owner fail, the finder may take ownership of it. If the treasure is non-Islamic and consists of gold or silver, zakat must be paid on it, which is one-fifth of its value. And Allah Knows Best.

Is it permissible to give my zakat to my grandson who is studying at university, while I am living abroad and my money is in my home country? Also, is it permissible to assign my father the responsibility of distributing the zakat to the people in my home country?

It is permissible to give zakat to a son whom his father is supporting if he is an adult and in good health, because his father is not obligated to support him, making him one of the poor among the Muslims. However, the student who may receive zakat is one who is diligent in seeking beneficial knowledge for the Muslims and is religious. Zakat should be paid in the country where the money is located, and appointing your father to distribute the zakat in the country where the money is is the correct approach. And Allah Knows Best.

Is it permissible for a wife to give her money to her family as a charity, or a gift without asking her husband, or seeking his consent?

The wife has the right to give her money as a charity, or a gift to her family, or to other people after consulting her husband out of respect, and this is the meaning of treating on footing of kindness and equity. Therefore, if he wanted to stop her from helping her family, then there is no harm in not telling him.

What is the ruling on combining prayers at the Musala (Place for prayer) of a shopping center because of heavy rain, knowing that some people come from outside that center?

Praise be to Allah, the Lord of the Worlds.

If there is hardship in going back to that Musala at the time of Asr or Isha` prayers, then it is permissible to combine prayers in twos only (Duhr with Asr and Maghrib with Isha`). Kindly consider calling us. And Allah Knows Best.

Relieving the People of Gaza is a Legal Obligation

"In the name of Allah, the Most Gracious, the Most Merciful"

Abu Hurairah [RAA) narrated that the Messenger of Allah (PBUH) said:

“……. A Muslim is a Muslim’s brother. He does not wrong, desert or despise him……..” {Related by Muslim}.

The General Iftaa` Department extends its sincere thanks to the Jordan Hashemite Charity Organization and the Royal Medical Services for their fulfillment of the collective obligation incumbent on all Muslims, and their continuous and organized provision to our brothers in Gaza - based on the royal directives - with some of the requirements of daily life: food, medicine, treatment, and clothing. This helps our brothers in Gaza to stand firm in the face of the difficult circumstances they face.

We urge all Muslims to cooperate with the Jordan Hashemite Charity Organization in sending aid to our people in Gaza. Indeed, it is Allah Who grants success.

I have vowed that if Allah gave me what I wanted so bad, I would fast every Monday and Thursday to the rest of my life; unless there is a valid excuse hindering me from doing so. Fortunately, Allah gave me what I wanted, so I started fasting Mondays and Thursdays; however, I stopped out of laziness. What is the Sharia ruling on this?

All perfect praise be to Allah the Lord of the Worlds. May Allah`s peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

Allah The Almighty described the righteous people of Jannah where He Said (What means): "They perform (their) vows, and they fear a Day whose evil flies far and wide." [Al-Insan/7]. Accordingly, you must do your best to fulfill your vow. However, if you are unable to do so, then feed a poor person for every missed day of fast (About half a JD), and if you are unable to do that, then offer expiation for breaking a vow, which is feeding ten poor Muslims (About half a JD for each), ask Allah for forgiveness and increase remembrance of Him. And Allah The Almighty Knows Best.

What`s the ruling on using the following materials in manufacturing cosmetics: olive oil, Vaseline, talc powder, glycerin, honey, almond oil, pine oil, galingale and marjoram?

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Mohammad and upon all his family and companions. None of the above materials is forbidden, and it`s lawful to use them in manufacturing products that are beneficial to people. This is because, in principle, all things are lawful so long as there is no evidence in Sharia indicating otherwise. And Allah Knows Best.

What is the best remedy for a person who experiences Waswasah (whispers of the devil) during Salah (prayer)?

Such a person should ignore the devil`s whispers, contemplate the Quranic chapters and verses that he/she recites, look directly at the place of Sujood (prostration), make supplication to Allah, and take refuge in Him from the cursed devil.

By slip of the tongue, my son cursed Allah. It is worth pointing that he has concluded his marriage contract recently, but haven`t consummated the marriage. What is the position of Sharia on this?

This person must return to the fold of Islam by uttering the two testimonies of faith and making repentance to Allah from all acts that lead to disbelief. Also, he must make a new marriage contract because the old one was dissolved after he had committed this act of disbelief. Moreover, since there is no waiting period for his wife, then she is in state of Talaq ba`en baynona Soghra (Minor irrevocable divorce); consequently, she can get back to him only by a new marriage contract.
