The Grand Mufti Denies the Invalidity of Divorce during the Curfew

 

His Grace the Grand Mufti of the Hashemite Kingdom of Jordan, Sheikh Abdul Karim Al-Khasawneh, denied what was mentioned in a message that some people are circulating, which attributes to His Grace the statement that divorce that takes place during the days of curfew is invalid.

 

He said that this claim is false and that divorce cases are handled by the Department`s Muftis during this temporary circumstance and in an exceptional manner to facilitate for the citizens. He added that it is necessary that people involved in such cases visit the Department after this epidemic ends to get a written Fatwa.

 

His Grace warned against circulating such rumors via social media and doing so is typical of the hypocrites and a form of lying and fabricating, which are amongst the major sins. Allah the Almighty says {what means}: " It is those who believe not in the Signs of God, that forge falsehood: it is they who lie!"

Quitting prayer is one of the major grave sins that come after disbelieving in Allah, but the wife of such a person isn`t considered divorced, rather, she should exert all her efforts in order to bring him back to the way of Islam. However, if his sin is likely to lure her from the way of Islam, then she had better separate from him by lawful means such as Mokhal`aa (When a wife pays a compensation for her husband in return for divorcing her). Moreover, if she exercises patience, and remains steadfast on her faith, then there is no harm in doing that.

Is Zakah due on the orphan`s money?

Yes, Zakah is due on the money of the orphan.

Is it permissible to offer mandatory prayer while sitting?

All perfect praise be to Allah, The Lord of The Worlds, and may His Peace and Blessings be upon our Prophet Muhammad and upon all of his family and companions.                                                                                                                                                                                                                            Standing up is a pillar in the mandatory prayer and the prayer is not valid without it unless one cannot do it. As for Nafila (supererogatory prayer), one can perform it in the state of sitting even if he/she can stand, but his/her reward is half the reward of the person who prays while standing if he/sh has no legal excuse for such an act. Is it permissible to pay the Zakah (obligatory charity) for settling the debt of a deceased relative?

It is impermissible to pay the Zakah for settling the debt of the deceased since Zakah is paid to eligible recipients who are alive. As for the debts of the deceased, they are to be settled from the estate before dividing it amongst the heirs, but if the deceased didn`t leave an estate, then it is desirable for his/her heirs to settle those debts if they can afford them.
