Birth of the Awaited Prophet

The birth of Prophet Mohammad (Peace be upon him) was exceptional in the sense that all humanity awaited it. Jews as well as Christians were awaiting that moment with all their hearts. They even knew that he was coming. The moment he was born, the whole universe was illuminated and peace and tranquility prevailed. This sign, led the People of the Book to know that the awaited Prophet was born.

The Jews came to Medina before the Prophet (PBUH) was sent with the Message of Islam, because they knew that it is the place where the awaited Prophet will appear. They even threatened the Arabs that they and the awaited Prophet of the end-time will kill them. Abu Na`im reported in [Dala`il An-Nobowah] that Abi Namlah said: "The Jews of Banu Qurayza mentioned Prophet Mohammad (PBUH) in their books and taught their children his name, attributes, and migration to Medina.

However, when he appeared they became envious, transgressed and met him with denial. Before he was sent with the Message of Islam, they sought his intercession and turned to him for help against the pagan Arabs. It is stated in Sirat Ibn Hisham: "The Jews said: "A Prophet will be sent now and we will follow him and kill you like the people of "Aad" and "Aram." Since the Prophet (Peace be upon him) descended from the clan of Quraysh, the Jews refused to believe in him." Allah Says (What means): "When there comes to them that which they (should) have recognized, they refuse to believe in it but the curse of God is on those without Faith. Miserable is the price, for which they have sold their souls, in that they deny (the revelation) which God has sent down, in insolent envy that God of His Grace should send it to any of His servants He pleases: Thus have they drawn on themselves Wrath upon Wrath. And humiliating is the punishment of those who reject Faith." [Al-Baqarah/89-90].

Similarly, the Christians were awaiting the birth of the Prophet Mohammad (PBUH). As reported by Abu Na`im in [Dala`il An-Nobowah], Qis Bin Sa`idah stood one day in Makkah and said: "A man from the lineage of Lu`ai Bin Ghalib will be sent to you and he will teach you to worship one God. Should I live to see that, I would be the first to believe in him…" Amongst the Christians who awaited for his arrival of is Waraqah Bin Nawfal who followed the religion of Abraham.

Waraqa gave the Prophet (Peace be upon him) the glad tidings that he (PBUH) is the Prophet of the end-time. When the Prophet (Peace be upon him) returned from the Cave of Hira` trembling, Khadijah (May Allah be pleased with her) called Waraqa to hear what happened with the Prophet (PBUH). Waraqa asked: "O my nephew! What have you seen?" Allah's Messenger (PBUH) described whatever he had seen. Waraqa said: "This is the same one who keeps the secrets (angel Gabriel) whom Allah had sent to Moses. I wish I were young and could live up to the time when your people would turn you out." Allah's Messenger (Peace be upon him) asked:  "Will they drive me out?" Waraqa replied in the affirmative and said, "Anyone (man) who came with something similar to what you have brought was treated with hostility; and if I should remain alive till the day when you will be turned out then I would support you strongly."

He (PBUH) was born under Allah`s Care. His father died when his mother was pregnant with him and she died when he was an infant. Having lost both his father and mother made him draw closer to Allah and being taken care of and raised by Him The Almighty. Allah Says (What means): "Did He not find thee an orphan and give thee shelter (and care)? And He found thee wandering, and He gave thee guidance. And He found thee in need, and made thee independent." [Ad-Duhah/6-8]. The Messenger of Allah said: "My Lord has taught me good manners."

Having taken care of Prophet Mohammad (PBUH) means having taken care of his nation. Allah has honored this nation with being Mohammad`s (PBUH). It is the best nation produced (as an example) for humankind. A nation of truth, mercy, and guidance to all humanity. A nation that didn`t tolerate transgression and injustice. A nation whose roots extended from the east to the west, as reflected in the remnants of its glorious civilization. Today, we are in dire need to revive the concepts of mercy and guidance with which the Prophet (Peace be upon him) was sent. This is to be considered worthy of him and his birth becomes truly the birth of a nation. And all praise be to The Lord of The Worlds.

Summarized Fatawaa

What is the ruling of Islamic Law on leaving the Sunnah prayer of Dhuhr due to fatigue?

Praise be to Allah, and peace and blessings upon our master, the Messenger of Allah.
According to the general rule, a Muslim should strive to maintain the Sunnah prayers before and after the obligatory prayers (al-sunan al-qabliyyah wa al-ba'diyyah). One is permitted to pray them sitting from the outset, but if one leaves them due to severe fatigue, there is no objection to doing so. It is recommended (mustahabb) to make up (qadā') a time-bound supererogatory prayer (nafl mu'aqqat) at any time if it was missed.
Al-Shirbīnī (may Allah have mercy on him) said: "If a time-bound supererogatory prayer is missed, it is recommended to make it up according to the more authoritative view (al-azhar), based on the hadith recorded in the two Ṣaḥīḥs: 'Whoever sleeps through a prayer or forgets it should pray it when he remembers it.' This is also supported by the fact that the Prophet (peace and blessings be upon him) made up the two rak'ahs of Fajr when he and his companions overslept in the valley and missed the dawn prayer until the sun had risen [narrated by Abū Dāwūd with an authentic chain]." And Allah, the Most High, knows best.

What is the ruling of Islamic Law regarding one who slaughters a ewe and it turns out to have been pregnant, and is it permissible to slaughter the ewe if one knows it is pregnant?

Praise be to Allah, and peace and blessings upon our master, the Messenger of Allah.
If a person slaughters a ewe and it turns out to have been pregnant, the fetus becomes lawful (ḥalāl) by virtue of its mother's slaughter (tabaʿan li-ummihā).
It is stated in Mughnī al-Muḥtāj (Vol.6/P.158): "A fetus found dead [after the mother's slaughter], or found alive but in a state resembling that of a slaughtered animal [i.e., dying shortly after], becomes lawful — whether or not it had grown fur — provided it is found in the womb of a mother that was lawfully slaughtered, whether her slaughter was by cutting the throat, or by an arrow or hunting dog sent after her. This is based on the ḥadīth: 'The slaughtering of the fetus is [effected by] the slaughtering of its mother' [narrated by al-Tirmidhī, who graded it ḥasan, and by Ibn Ḥibbān, who graded it ṣaḥīḥ] — meaning that the slaughter which rendered the mother lawful renders the fetus lawful as well, by virtue of following her; and because the fetus is one of her constituent parts, and her slaughter renders lawful all of her parts."
This ruling differs, however, from the case of one who knows from the outset that the ewe is pregnant [and intends to sacrifice her specifically as the udḥiyah while pregnant] — in which case, according to the Shāfi'ī school, she does not fulfill the requirement of a valid sacrifice.
It is stated in Ḥāshiyat al-Bujayrimī 'alā al-Khaṭīb (Vol.4/P.335): "A pregnant animal does not fulfill the requirement [of a valid sacrifice], and this is the authoritative position (al-mu'tamad), because pregnancy diminishes the quality of the meat. As for why such an animal is nevertheless counted as complete [i.e., fully valid] in matters of zakāh, that is because the intent there is reproduction (nasl), not the quality of the meat.". And Allah, the Most High, knows best.

What is the ruling on a Friday sermon in which the khaṭīb did not explicitly exhort the congregation to be conscious of Allah (taqwā) in both sermons, but sufficed with commanding them to obey Allah and refrain from disobeying Him?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
For the Friday sermon (khuṭbat al-Jumʿah) to be valid, certain essential pillars (arkān) must be fulfilled. Among these is the exhortation to be conscious of Allah (waṣiyyah bi-taqwā Allāh), which must be present in both sermons. Alongside this pillar, the praising of Allah (ḥamdallah) and the sending of blessings upon the Messenger of Allah ﷺ are equally required.
Shaykh al-Islām Imām Ibn Ḥajar al-Haytamī, may Allah have mercy upon him, states: "These three are pillars in each of the two sermons, because each sermon is independent and separate from the other." [Tuḥfat al-Muḥtāj,Vol.4/P.447]
It is not a condition that the exhortation be expressed in any specific wording, nor is it required that the word "taqwā" itself be used — such as saying "I exhort you to be conscious of Allah." Rather, this pillar is fulfilled by any expression that contains a command to obey Allah the Almighty and to abstain from what He has prohibited.
Imām al-Khaṭīb al-Sharbīnī, may Allah have mercy upon him, states: "The third pillar is the exhortation to taqwā... The specific wording of this exhortation is not required, according to the most correct view, because the purpose is admonition and the urging of obedience to Allah the Almighty. Therefore, any expression that conveys admonition suffices — whether long or short — such as: 'Obey Allah and be ever mindful of Him.'" [Mughnī al-Muḥtāj,Vol.1/P.550]
Accordingly, what the khaṭīb has done — by commanding obedience to Allah and forbidding disobedience to Him in both sermons — is valid and sufficient. And Allah the Almighty knows best.

What is the wisdom behind legislating the Udhiyah?

The Muslim must know that through the Uḍḥiyah, he complies with the command of Allah, the Exalted, and performs a worship that brings him closer to Allah and distances him from the Fire.

The Uḍḥiyah holds profound wisdoms and noble meanings, including:

1-Reviving the Sunnah of Abraham, peace be upon him: He complied with Allah's command when He ordered him to slaughter his son Ishmael. Abraham, peace be upon him, succeeded in the test, and when he was about to slaughter his son, Allah sent down a ram to ransom Ishmael and commanded him to slaughter it instead. Allah, the Exalted, says {what means]: "And when he reached with him [the age of] exertion, he said, 'O my son, indeed I have seen in a dream that I [must] sacrifice you, so see what you think.' He said, 'O my father, do as you are commanded. You will find me, if Allah wills, of the steadfast.' And when they had both submitted and he put him down upon his forehead, We called to him, 'O Abraham, You have fulfilled the vision.' Indeed, We thus reward the doers of good. Indeed, this was the clear trial. And We ransomed him with a great sacrifice." [Al-Ṣāffāt/102-107]. Thus, the sacrificial offering became an enduring Sunnah until the Day of Judgment, and Muslims offer their wealth as sacrifices, drawing closer to Allah, the Exalted, reviving this great Sunnah.

2-Providing abundance for people on Eid day and the Days of Tashrīq: Among the wisdoms of the Uḍḥiyah is that the Muslim provides generously for his family, neighbors, relatives, and the poor during these days. The Muslim is encouraged to eat from his sacrifice, give charity from it to the poor, and gift from it to his wealthy neighbors. Thus, goodness spreads throughout the entire community. The Prophet, peace and blessings be upon him, said: "The Days of Tashrīq are days of eating and drinking." (Narrated by Muslim). Allah, the Exalted, says {what means}: "And the camels and cattle We have appointed for you as among the symbols of Allah; for you therein is good." [Al-Ḥajj/36]. This good includes the good of both this world and the Hereafter.
